Even if you accept everything Mariner says as fact (which I personally don't), that still would only mean that he had not publicly returned as of 2381.
Honestly, thinking on it, what was established in Lower Decks is as vague and open to interpretation as what happened in Starfleet Academy. It wasn't anything that Mariner said, Sisko wasn't even mentioned by name in the episode, it was Kira's contemplation of the wormhole with Sisko's baseball still on the desk. Honestly, both stories leave things open to interpretation, so I really fail to see the problem. He is still, as Darem called him, "Schrodinger's Prophet". We don't really have any more of a definitive answer to the Sisko question after Series Acclamation Mil then we did before. I don't even think that providing definitive answers was even the point of the episode. I think we all would have liked details on that happily ever after for Sisko and Kasidy, but I honestly wasn't expecting it one way or the other.

At any rate, reportedly Avery Brooks was pleased with the final product, and if it pleased him, then I can live with it too.

The episode I was referring to is one where Mariner says that Sisko is off working in the Celestial Temple.

Mariner "What? No, he's working hard in the celestial temple." (Sounds like she might be saying 'a' celestial temple rather than 'the' though, I'm not sure.)

I will admit that I had forgotten about that, but I agree with you that that shouldn't be taken as literal truth. At best, it's what the public knows and not necessarily what really happened.

I’ve been waiting for something like this since 21st century Trek has been streaming. I mean our, actual 21st. There were references to Gul Dukat and Martok in Picard. I heard there were some signs, in city scape scenes, for Quark and Cassidy. I never caught those. I didn’t watch much of lower decks. I just wanted to see something, anything, about Sisco. As we watched, my wife was checking my eyes for tears. I’m glad to see Jake.

I hated it too. Some small things I liked, but I did not like the direction they took the story, and I did not like the student tomfoolery, and I did not like the numerous careless errors made on the Sisko family tree. (I wouldn't care as much about that if I liked the episode, but here we are.)

I don't hate it with all my might, but I hate it with moderate strength.

Those in charge of background graphics have never been the best. The family tree and the wall of luminaries are very lazily done. But this is nothing new to Acadmemy and has been a problem in the franchise for decades. Even ship registries get borked, Prometheus and Athena have the wrong numbers on their hulls.

Errors happen, yes. A few crop up throughout the franchise. Most can be excused because it was usually small and really background. Plus the extremely short amount of time to get all that done, usually merely a couple weeks, plus a season of 26 episodes a year... it's frankly amazing they got so little incorrect back in the classic era.

But in this case, not only are these graphics NOT in the background (especially the Sisko family tree, which was front and center and was the focal point of an entire scene), but these people have over a year to get these things right. And with less than half the episodes to produce.

So the hate that these errors get is rightly deserved. Particularly in the case of Sisko's family tree, since all those errors were EASY to research.

Oh I'm in no way defending the family tree or the wall of luminaries. Just pointing out that it isn't a new problem.
 
Basically, if they were never going to have Avery Brooks physically participate in any form in this episode, its frankly insane that it exists. Moreso to ruin the illusion for many fans (myself included) that Sisko may have returned one day, but the ambiguity nevertheless is lost, and I won't forgive them that.
