Seriously, I liked that the PD situation here was ambiguous and open to interpretation. Pike made his call, but another captain might well have justified making a different call. I think the PD works best, storytelling-wise, when the situation is NOT clear-cut. Better that it pose thorny dilemmas than be treated as a hard-and-fast rule.
Lord knows Kirk had a more "flexible" approach to the PD than Picard did . . . .
