Warners has completely control of the DC Comics IP. They can do whatever they want with all of DC's characters. It isn't a mess like Marvel.

I've heard people argue that the opposite would be needed. Without express permission, it gives them the rights to do X only. With Gotham, they have the rights to have Batman characters on a television show. Right now, they have the rights to put X-Men characters in a movie. They have to get permission to make X-Men on TV. Even then, it'll let them make an X-Men TV show. Gotham isn't an X-Men TV show (obviously).
There's a lot of talk about having the Fantastic Four and X-Men cross over, but they often back off that idea after proposing it and people think the contracts are for Fantastic Four movies and X-Men movies, so they can't do crossovers.
At which point you get non specific background continuity - a newspaper headline 'Four People Caught In Reactor Malfunction' or a TV newspiece in the background of a scene, a guest appearance of an actor without using the characters name etc.
Slightly off topic - anyone know if the Rogue Cut of DOFP changes the continuity at all for Apocalypse ?

Well, Rogue only appears in the "present/future" portions of DOFP rather than the historical portions, and Apocalypse is apparently set in 1983 and focuses entirely on the younger cast. So I doubt the Rogue Cut will have any effect.
Oh, and it comes out May 27, 2016.
