I mean, sure, Kirk was already a Lieutenant by that point, but it still begs the question. Were there absolutely no other senior officers aboard? No LCDRs or CDRs? I find that unlikely.

When he and Sulu are being transported up from the drill, the readout screen identifies Kirk as a Lieutenant.
My guess is that during the hearing, which is interrupted by the attack on Vulcan, Kirk was about to graduate from the Academy with the rank of Lieutenant just like he did in the prime timeline. So since he was going to be given that rank anyway, that's what the transporter readout said he was.

Well, Riker didn't, but the implication is he could have easily kept his Captain's rank and been given command of another ship, he just chose to stay on the Enterprise as first officer. As for Shelby, we really know nothing of her post-TBOBW, so she could very well have kept her new rank at her next assignment.We see both Riker and Shelby have their field promotions not made permanent in "The Best of Both Worlds".

Still, command would fall to the next highest ranking officer on the Enterprise's crew. Whoever that was could turn command over to Scotty, but it would have to be their choice. I don't think they legally can in the modern US navy. In order to command a ship, they have to be part of the chain of command.
