What is THE Worst continuity error in Trek history..?!

The regulation states that the CMO, McCoy in this case, could relieve any officer, including the Commanding Officer, if he or she displays signs of mental illness or otherwise mentally incapable of effecting command - Spock 2 clearly couldn't

I'm aware of the regulation. It was a joke. Obviously, Sulu would take command.
 
Of course, the nu-Trek's regs are not exactly stable or clear

None of Trek's were. Sulu took command of the Enterprise multiple times over the higher ranked Scott. In "Arsenal of Freedom", LaForge was given command over the higher ranked Chief Engineer Logan. And those weren't the only instances.

That was because the commanding officer, Kirk and Picard, gave a direct order for the officer to assume command - that is the basis of La Forge's refusal to step aside

Pike made Kirk the Enterprise first officer, so it was Kirk's play when Spock fell off the sanity wagon.
 
That decision did seem a bit offbeat. But at least Delta Vega had a Starfleet outpost where Kirk could stay until such time as some ship might be passing through the area again and could pick him up. It's not like Spock left him in the vacuum of space or something.

But why not put him in the brig instead?

Probably right. But at the same time, McCoy was just the acting CMO and probably on his first deep space flight. His head was probably spinning.

No, he was appointed by the ship's acting commander to take that role - besides, even if he was the acting CMO, he would still have that right

Not sure "you have inherited his duties" constitutes a binding appointment. Heck, we don't even know if Starfleet would've left Spock in the center seat if things had played out differently. We see both Riker and Shelby have their field promotions not made permanent in "The Best of Both Worlds".

I'm not saying that McCoy didn't have the right, as acting CMO he clearly would. What I'm saying is that McCoy may have been a bit overwhelmed.

For me, this really gave the whole thing a "wild frontier" feel. A ship is a self-contained unit out there exploring the unknown, and Pike uses his experience and judgment rather than relying strictly on some hard-and-fast rules made by paper pushers back at Starfleet HQ.

responsibility as Chief Medical Officer.

That suggests from that moment onwards, he was the CMO
