SPB - I was saying you were wrong. (Sorry.) Just surprised by no activity . . . .

Okay, another clue:

1. Makes a military statement that is oddly false.
2. But is broken up about it, in a way not often seen.
3. Should have been uncomfortably showered with affection?
 
Ah OK. I thought so. The inactivity in the responses is just due to activity in our brains leading to no answer worth stating. The new clue might help though.
 
Scotty in "Trouble with Tribbles"

1. After transporting the tribbles over to the Klingon ships he says, "I gave them a good home ... where they will be no trouble at all". Certainly this is not true. It's not a good home and it will cause trouble for their military adversary.

2. He is strangely not proud about it and it trying to avoid the interest Kirk is showing.

3. Should he be congratulated for solving a problem and not killing the tribbles, or should he be condemned for only delaying their killing because the Kingons will likely just exterminate them.
 
Chekov in "Day of the Dove"

1. Makes the false statement that his brother was killed in a Klingon attack.

2. His response is unusual for him

3. The Klingon commander shows Klingon affection (respect) for his loyalty and willingness to sacrifice himself
 
Joe Tormolen?
1. ??
2. Joe was incredibly upset about the six dead crew of the research station. Super grief:
TORMOLEN: Terrible, Captain. It was terrible. They were just sitting, like they didn't care. Whatever was happening, they didn't care. I keep wondering
KIRK: You keep wondering if man was meant to be out here. You keep wondering, you keep signing on. Any guesses, Mister Spock? Any idea of what happened down there?
SPOCK: I wish I could say, Captain. The circumstances were quite bizarre, however our record tapes may show us something.
TORMOLEN: Six dead. Six people dead.
3. Only picking up the shower scene in The Naked Time. Joe reported:
TORMOLEN: Well, better look for yourself, Mister Spock. One man was taking a shower fully clothed. (they split up, he takes off his glove to scratch his nose then puts it on the console. Something orange jumps onto his skin. Feeling the cold he puts the glove back on)
SPOCK: Be certain we expose ourselves to nothing. (Oops.)​
 
Yup! Good job, Henoch. It's poor Joey. You were spot on for #s 2 and 3. #2 is also a double entendre on Joe's rank of LTJG, the awesome single broken stripe that is sadly almost never seen again. #1 is a reference to his odd line to Sulu, "You don't rank me," when in fact, Sulu, uh, does.

I'd label Elaan with another word besides cranky...:whistle:.

2nd Clue: A conspirator to murder after the fact.
 
Daystrom was not guilty by reason of temporary insanity.

3rd Clue: Legally, Kirk is the guilty party, not our conspirator.
 
Evil Duplicated Kirk

1. He is Mr. Cranky-pants incaranate
2. Two Kirks become one and both Kirks conspire to make one Kirk, hence one is murdered
3. Normal Kirk is left and is the only one legally able to face the consequences.
 
I assume that means accessory after the fact to conspiracy to commit murder . . . ?

In any event, I'll go with Nancy Hedford. She presumably consented to what the Companion did, which was effectively murdering Ms. Hedford (we'll table discussion of the important legal distinction between murder versus suicide for a moment), she was quite cranky with McCoy, providing a nice contrast (actually Metamorphosis is an absolutely outstanding McCoy episode), and Kirk is the one who actually planted the seed of Ms. Hedford's end, and he was in command when it happened. it's a stretch but I like the guess. We'll see.
 
Not Evil Duplicated Kirk and not Nancy Hedford. @Phaser Two 's assumption is spot on, "accessory" is a better legal term. I should clarify that it was also accessory after the fact to conspire to commit multiple murders.

Clue Summary (with corrections and hints):
1st Clue: Hard to believe, but more cranky than McCoy.
2nd Clue: A conspirator to murder after the fact.

3rd Clue: Legally, Kirk is the guilty party, not our conspirator.
(It may be a different crime, and in court, it may not even be a real crime.)​
4th Clue: Later on, McCoy is gentle and supportive to our conspirator. Is McCoy part of the conspiracy, too?
 
Professor Crater is all I can think of.

1. Very cranky, yes.
2. Aided the creature after it killed so many people
3. No idea about this one.
4. Not the real McCoy (sorry for the pun) but the creature takes on the form of McCoy and is gentle and supportive

You got it right for the clues. For the 3rd Clue, Crater told Kirk was trespassing on his planet:
CRATER: Captain, considering the inescapable fact that you are a trespasser on my planet
KIRK: Your complaint is noted, sir.
Even Kirk seems to admit that he is guilty of trespassing, and acknowledging that the planet is somehow Crater's property. Maybe he is only leasing it or part of some sort of grant arrangement.
