It's easier for CBS to just make something new, from both a business and a legal standpoint, than to take over some fanfilm. It's just too much of a rat's nest in terms of rights and contracts from the WGAw to CBS.

What about taking over from Bad Robot, setting a series in same "universe" with the same general feel? Essentially picking up from Star Trek 3? Would CBS be on the hook to compensate Bad Robot?

Setting a series in the BR universe would also be a legal mess, because I am pretty sure they would have to ask / compensate BR or even Paramount for the usage of every element that BR did (e.g. all the designs). It´s really a legal nightmare they brought upon themselves.

I'm not sure how it works with two production companies? From what I've seen writers of the novels say is that anything they create within a Star Trek novel (characters, situations, ships) belongs to CBS.

All these rumors stem from an idiot who calls himself Para Mobius telling some fans on Facebook what they want to hear. It's made up, either by him or someone feeding it to him. If we'd been having this conversation three weeks ago his followers would be insisting that no Star Trek 3 is going to be made at all - that's what Para was feeding them. He's now come up with excuses and backpedaling to void those claims.

AFAIK he's not a member of or poster on TrekBBS.

ok, back on topic: pretty damn cool to see that they are talking about putting out a video game in the Axanar "universe"...

hopefully, it will be flying various ships on missions on both sides of the war, with on-line MMP...

The difference is Bad Robot was hired to make those films. It's no different than contracting Gene Roddenberry's Norway Productions to make TMP. It's work for hire. There are rules about what happens if someone creates characters for an episode or a film, and said characters get reused in subsequent productions. It's why Paris was Paris and not Nick Lacarno on Voyager: you have to pay the writer every time you reuse a character they created (the rules are different for staff writers). It cuts into your profits to pay out to an outside writer, ergo, it's easier to just make up new characters. So, if you keep Garth, you'd have to pay the estates of the originating writer(s) for each segment Garth appears in. If you use the other Axanar characters, you still have to pay the writers who created them. So, why bother? Just make your own show without that baggage.

The producers of TNG included the character "Mirasta Yale" in the episode "First Contact" as a potential recurring character to replace Wes Crusher when it was known that Wheaton would be leaving the show. One reason that didn't happen was that free-lance writers were credited on that episode along with staff. Ensign Ro, created by staff writers, eventually filled the desired role.

Why can't Axanar be "hired" by CBS?
