To them, it's not windmills. They are very much giants to be defeated. It has consumed their identity, to the point that rationality is no longer possible. It is a highly emotional, impulsive, pushback against a perceived attack on something incredibly precious.

Even if abdin wins they are not going to get what they want which is DSC cancelled and moved from canon.
 
The best this can lead to is a very slim chance to get to a Jury Trial or CBS making a minuscule deal offer.
And even if it gets to trial, unless they stack the jury with disgruntled Star Trek fans, I wouldn't wanna bet any of my money on Abdin winning.

If CBS was going go cut a deal they would have already.

Right now CBS has argued and gotten the case dismissed by saying that what he claims as infringed isn't actually copyright protected. Should for some improbable reason the appellate court decide that they are protected after all, CBS can instead go with the improbability of the timeline of events. The whole "they stole my giant tardigrade" bullshit can be disproved by simply showing the production notes on when episodes 3 - 5 had wrapped up filming. Given that one hour dramas usually take up to 8 days to film (not sure if that counts the weekend), and an effects-heavy show like Discovery will need a bit longer in post than a "normal" show, I wouldn't be surprised if Discovery's Ripper was already being filmed when Abdin posted his game trailer.
 
Plus CBS probably has evidence that can counter his claims if they're asked for it.

Yeah the judge didn't really address the timeline in the deicion (I'd assume because if they are not substantially similar it wasn't revelant) but as discussed in the other thread the timeline also does not work to Abdin's favor even if declared similar .
 
They also had a life sized cardboard standee for use on set.

Also, I just checked and Discovery filmed from January to October 2017. Since they'd hardly have filmed them out of order, even with a very generous allowance for supposed dalliance, 3 - 5 should have been done filming at the latest late February to mid-March. So long before Abdin published his trailer.

And when you add in storyboads and scripts and casting (since he claims characters were stolen too) you need to go back about another 6-9 months as well.

So yeah the timeline is a huge problem for him.

As I said in the original thread I think a lot of his thoughts about srtuff being stolen is stuff he had through of and planned to do that hadn't yet been released to the public. Hes seeing things nobody else can because he knows what his finished game is supposed to look like... problem is CBS never saw that or had a chance to since the game is still unreleased.

I have to be honest, I really feel bad for Abdin. What a sad way to use up your 15 minutes of fame...
 
Oh, that video is really good. Ketwolski continues to be one of the very few YouTube personalities who says reasonable things, and I appreciate that quite a bit.
