Court Martials aren't civilian.Because they are ostensibly on the frontier, and a full civilian court set up is hard to come by. Hence measure of a man etc.

Well they do say actions speak louder than words...They narrate one thing with mouths and another with their finger on the trigger when war is declared.And therein lies the rub....for if there is no compromise, the ramifications alone mean the only stated fact is that Starfleet is not military....or many of the hero protagonists in Trek suddenly become unreliable narrators at best.
