Let's go with by a preponderance of the evidence. Clear and convincing is too high, and probable cause is too low.

There is nothing wrong with assuming that someone is homosexual until proven heterosexual. It's enlightened, even.

1st, I would asume heterosexuality because of evidence on screen, ie: predilection for Spock being interested in females ("Cloudminders", "Enterprise Incident", "This Side of Paradise","Amok Time"), secondly, I would also assume heterosexuality because 90-95% of human males are hetereo...and Vulcans show no signs of being different. In fact screen evidence shows 100% at this point. And no, basing my opinion on the preponderance of evidence is not prejudiced. I'm happy to modify my opinion based on the facts, which of course, you have none.
