Foreign language translations of ST novels

The moment Clawhammer would try to stop them from using it or demand monetary compensation he would open the doors to legal actions against himself by the owner to the rights to the original DeBoer photo since then his "fan work" becomes commercial.
 
Yet if that were wholly true, then wouldn't the fanficcers who caused this rule to be put in place here on the forum have been subject to the same sort of counterclaim? Yet it's the authors who have more fear of consequences than the fanficcers; that would not be had it not been the author who suffered more than the fanficcer in the case in question.
 
The rule was put in place not because the fanfic writers would have any chance in hell to win a legal suite, but to protect the writers from actually having to put up with that crap despite the fact their eventual victory is pretty much guaranteed. Every fan fic writer who would be stupid enough to sue deserves the ass whooping s/he would get in court.

So as I said, most likely Clawhammer would dig his own grave if he would make a bit fuss about it. If the actual rights owner would step in, that would be whole different matter.

That's why I always stated that I made it as a fan and not as something official, that is also the reason that I cannot be more then slightly annoyed about it. :)

Also I recieved an apology from the cover designer(s)? that this was used as a studyobject and was not intended to be shown online or used in a final version. Good enough for me, so lets move on!
 
Not necessarily so. The whole reason we're not allowed to post fanfic ideas in here is because if a professional author used them and the fanfic writer--regardless of the fact that they were using the author's or franchise's intellectual property--wanted to press the point, it could result in serious litigation for the author even if the judge did not find in the author's favor.

That's basically right, but the mistake you're making is in using that as an analogy for the case of the altered photograph. It's not really equivalent. A work of fanfic may use the established characters and concepts of ST, but the actual work itself is a new creation. By contrast, a doctored photograph is taking an existing work and modifying it. The analogy in prose would be taking a whole paragraph or chapter from someone else's work and rewriting portions of it.
 
I have some Portuguese translations of the Gold Key Comics, and a few Brasilian translations of the DC Comics run on TNG.

It's easy to tell the difference because of the differing translations for the name Star Trek itself: Caminho das Estrelas (Portugal) versus Jornada das Estrelas (Brasil).

As far as I know it's only one cover designer, Martin Frei (you can find some infos about him here).

And maybe he should tell the guys at CrossCult that they're not supposed to put his drafts online since they do it with a certain regularity.

You already had scans of all the Gold Key translations I own, so here are the two Brasilian DC translations I have, at the same resolution you have on your site:

Despite having the cover for Issue 7, this has Portuguese translations for the first issues of the TOS Volume 2 and TNG series from DC.

It's the same sort of deal here...the cover for TNG Issue 1, but the stories from TOS and TNG Issue 2.
