I will agree with you that there is no real evidence drug use is illegal in the Federation.
What I will not agree with is 'no reasonable person thinks tobacco should be illegal'. I most definitely think it should be illegal. Unless you believe I am not a reasonable person.
Cigarettes do nothing but get people addicted and kill people. (It's why my grandfather didn't live long enough to even reach retirement age.) Plus, it also affects other people who have never smoked, or do you think the consequences of secondhand smoke are a myth?
It's one thing to be putting bad chemicals and products into your own body. It's quite another to be using such things that have a measureable, proveable hazard on people around you. So yes, I most certainly think it should be illegal.
Where was it ever implied in the episode that what M'Benga and Nurse Chapel were injecting into themselves was either legal or condoned by Starfleet or the Federation?
By the discussion they had before doing it, it was pretty clear that this was both illegal and not condoned by any Federation governmental entity. They didn't take the action that they did to inject themselves lightly.
