The death penalty might never have been enacted by Starfleet -- it could be just another illusion put in place by the Talosians to make sure they're left alone.

"How do we make sure the humans never come back?"
"Convince them that it's punishable by death?"
"Works for me. Who wants an orange whip?"

And it made for some nice drama when they called for Spock to bring Pike "home."
 
You probably GUSH waaayyy better and more than I do though.

I can't wait for more Trek shows, so I can GUSH more than once a week.
(although, at my age I probably shouldn't over do it)

I think Pike is the glue to this season, much as Lorca was the glue for last season. The show is a little over-reliant on their Captains, which is interesting, as it was something they were trying to avoid.

The show is turning into more of an ensemble and has lot of moving parts to it now, so it's heading away from being as Burnham-Centric. I don't think it's any one character that's the glue holding things together. I don't even think it's Pike. It's more of a combined effort.
