In general: man oh man all the BTS feuding and backbiting just gives me a headache. All of it can go straight to the lake.

True, but lawsuits and lawyers, along with public sniping across channels in fan productions make me fidgety, and if I get fidgety, as someone who has no money invested in either production, then I'm sure CBS' lawyers will get fidgety, because they do have money invested in the Star Trek brand, and anyone using the IP who may malign that brand, or bring negative press to it, may need squished. I don't want that to happen.
I'm going to take a swing and say that the Axanar people are hedging their bets on this never actually reaching the courts. In Australia at least, most cases are settled before-hand, and if they're not then the court will do its damnedest to make you try ADR first. Besides the usual shebang of the parties not being able to afford to go to actual litigation, cases like this waste the courts time and cost the public money. No one wants them to get too far if they can help it.
Based on the limited information given, I can see a million holes in this supposed case already. A big one being that they'd have to prove Mignogna is planning to spread these 'lies' in the future (for eg. like writing a book or holding a meeting), otherwise cease and desist letters don't cover this sort of situation (can't 'cease and desist' something that's already happened).
A defamation case fits better and maybe they're talking about a letter of intent, but that would mean they're going after damages or compensation - an action that would be a bloody stupid waste of money and time. If you need to know why, consider why Paramount or Abrams have never bothered bringing an action against Para Möbius for provably making the exact same embezzlement accusations.
But just from a PR standpoint, posting this on Facebook seems like such a
stupid thing to do. Theyre advertising to the people
voluntarily paying their bills that they're going to be tied up in expensive, non-necessary legal problems.
But that's just a final year Australian law students perspective, and I admit that I dont have all the facts . I have no doubt there are smarter people than me who could make a good arguement for it. But at this moment, I think this post is just a frustrated attempt to scare Mignogna into shutting up. Hot air, basically.
