What is Data's rank?

The resurrected Data wears a kind of uniformy thing, but does he actually have a Starfleet rank? (I don't remember if he wore rank pips.) If so, what IS his rank?

Also, would Starfleet consider this Data to legally be the same entity as the original?
 
He is presumably still a Lt Commander, just as he was when he died until and unless Starfleet decides to promote him. Assuming he even wants to stay in Starfleet.
 
SF would probably have to declare him "alive" before he could be reinstated into the service, but like Wormhole said, only if Data wants that.
 
Lieutenant Commander, if he is still considered to be a starfleet officer at this point.
 
I’m sure Lt. Commander must be correct.

But in my head cannon after season 3 ends he just hangs out with the LaForge family as the fun uncle.
 
Spock left Starfleet some time after TOS, but when he returned in TMP, Kirk had his commission reactivated and retained the rank of commander. Presumably, the same thing can be done for Data if Picard, Riker, or LaForge vouched for it...

No, because it is not the original, and whether Picard pulls another "A Measure of a Man" and make the argument what that representation of Data was in Picard season 3?

What was it's rank, if so??? I believe it would not have a designated rank but instead have an "acting" position in Starfleet.

Seriously. The original Data was male, and so is this one. That shouldn't ever be in doubt. Just because he's an artificial life form doesn't mean he doesn't have a gender! In any case, the use of the word 'it' to refer to ANY sentient being would be extremely rude, I should think.

As for his rank, I think it could go either way. I'm sure Picard would use all of his Starfleet clout to have the new Data accorded the same rank and privileges as the original.

At least Bruce Maddox is no longer around to argue against him.

Data should still hold the rank of Commander, he got a promotion in ST:NEM
Spock would still hold the rank of Captain, but technically he's retired from StarFleet and is a ambassador for the UFP before he crossed into the Kelvin Universe.

I would say no. The Data we knew was physically destroyed in "Nemesis" and his consciousness ceased to exist in PIC S2. The Data we saw in PIC was constructed from the memories of several androids, with Data and Lore being the dominant ones. Because an android's personality is the sum of their memories (that's how Lore was defeated; he absorbed Data's memories and effectively became Data), the end result was a similar entity, though not the same.

Data Mark II, if he chose to, could certainly apply for Starfleet service if he chose, and he would probably be commissioned at his prior rank. No guarantees, though.
 
I thought his consciousness was transferred to B4, then stored at s31 with Lore. They all then were combined into the synth we know today.
