What is Data's rank?

Data Mark II, if he chose to, could certainly apply for Starfleet service if he chose, and he would probably be commissioned at his prior rank. No guarantees, though.

Yeah, Data's unique status as an android could certainly be a factor. Even Seven had to attend an Academy training program, didn't she? But Data might just have to go through a legal formality and then be commissioned at the same rank as the original.
 
Data, should he decide to return to Starfleet, would probably need a refresher course. He has been out of service for over twenty years. That's a least an hour of relearning for Data. Plus, his humanity it very much a new thing to him, that could add some time to his reeducation and evaluations by Starfleet.

Agreed. I think they would evaluate him beforehand. If they decided to bring him back, they would reinstate him at LCDR, but put him in a staff job at first, maybe a liaison to the synth planet that just gained protectorate status. It might be awhile before he went out on a ship again.

IIRC, the novelization indicated he was to become the new XO after Riker left, which the "Litverse" continuity acknowledged, but that's not canon at all.

It's obvious enough in the movie as-is, even though no one says it in so many words. As soon as Picard starts joking about his tyrannical new first officer at the wedding, everybody, including him, looks at Data, and Data defends the first officer sticking to protocol in the hypothetical.
 
Riker had not yet departed for his new command, so he was still Enterprise's first officer (hence his presence in the movie). Once he made his departure, Data would have become first officer, put on a red uniform, and been officially upped to commander.

One of my many reasons for disliking Nemesis is that Data FINALLY is up for the promotion he deserved 12 years ago... and he dies. :mad:

An hour? He could probably catch up in ten seconds, if that.

And perhaps not even then. Perhaps Alton programmed him with the latest in Starfleet tactics and knowledge? Who knows, Data II could already know everything he needs to know.
 
How in the world would Soong know 25th century Starfleet protocols? Why would that be treated as subsitutianary to actual Starfleet training and why accept it without any measure of training?

Considering this new personality is also derived from the unhinged Lore, I have a hard time believing Starfleet would slap a few pips on his collar without an exhaustive examination. What if the Lore side of the personality reasserted itself in a critical situation?

Because of course Data never went rogue in a critical situation...

Not exactly. It was an integration, as Data's memories reasserted dominance, creating a hybrid. He is a new being, despite having Data and Lore's memories. And other pieces too:

You are right. I misremembered it
 
IIRC, the novelization indicated he was to become the new XO after Riker left, which the "Litverse" continuity acknowledged, but that's not canon at all.

Also, I think(?), mentioned in the toast scene between Data and Picard that was supposed to be early in the film, but not used. Included in "Bonus Scenes" on the DVD and, for me, would have made the important emotional counterweight needed to balance Data's sacrifice at the end.
