He was on the shortlist for the first movie, but didn't want to do an origin story, so they went to Raimi instead. With his Zodiac writer plotting this one, why not? Though it looks like they want to go more of a teen-friendly route this time, so I suppose he probablt doesn't fit the bill.
My prediction earlier in this thread was of a Batman Forever type reboot, rather than in the Begins mould. New director, cast, new tone, but not a total re-telling of the origin. I seem to have been mostly right, but we'll have to wait and see how far they re-tell the origin; I suspect at most we'll get a flashback, a la Incredible Hulk, or indeed, Batman Forever. I still hope and suspect that JK Simmons will be back (a la Dench in Casino Royale or Michael Gough and Pat Hingle in BF).
I don't have a problem with this being set in high school, as that's where Spidey's classic tales originated. As has been said, the Spectacular Spider-man cartoon is very good and keeps that setting. I'm 37 but I always think of Spider-man as a young adult or teenager and I think a 30-something Toby was getting too old for the role. I think you can make a Spider-movie with a teen Spidey without it being Twillight.
I'm glad also that the release date has been put back for a year, allowing them to hopefully get it right. By all accounts, the scripts for the Raimi/Maguire version STUNK!!!!
