I would think that with Kurtzman being closely tied to JJ Abrams, Section 31 would be a "Alias" type TV show.

But the big difference is that Section 31 would be the protagonists and the "Good Guys", unlike SD-6.

The show is not canon. Canon is what you make of it. It's pretty clear that such a show doesn't fit your view of Trek so perhaps regarding it outside of the Trek box may be best.
