most "normal" people don't know KIRK is dead

Well, it does make a big difference. I know for some of us its hard to accept, but the fact is? There are fans of Shatner outside of Trekdom. BOSTON LEGAL is pretty big where I work and I would bet maybe only two or three of us are Trek fans. Most of them think we are dorks. But they like Denny Crane and if putting Shatner in that movie could have brought new fans to the mix, then it does make a big deal if they don't know his character is really dead or not.
So. Sorry to disagree. But Shatner is right, and so are many of his fans. His not being in that movie based on events that happened in a 'failed' movie makes no sense. Kirk being in that movie would make about as much sense as inventing a Borg Queen out of thin air to appeal to horny teenager boys. And last I checked, FC was considered the best TNG Trek movie (though I think Generations was)
And I know many TREK fans hate the shatman. I know many don't even watch Boston Legal. But I know that about 12million people do watch Boston Legal, and from what I can tell, the make up of LEGAL's audience is not the same as Trek's. Rich white liberals watch Boston Legal. Young men 18-42 watch Star Trek. Two totally different groups. Why not go after both?

So if the script requires an elderly Spock, he should have been a new actor as well?
IIRC, the reason Nimoy is in the film is that the writers conceived a story that would involve the iconic Spock character at two distinct ages. It would be silly to recast Old Spock on a whim, to keep everything fresh, if Nimoy was going to be interested in playing him.
The addition of Nimoy was controversial and pulls in the nostalgia quotient needed for success, but you only need so much to keep the free publicity machine rolling. A Shatner-and-Nimoy cast announcement wouldn't necessarily cause a doubling of publicity.
Epecially when JJ promised fans that his production team had a respect for the weight of ST continuity over 40 years. Inventing a reason to raise Kirk from the dead would not be respecting that continuity. Fans would say it reeked of lack of faith in the new script.
I agree, to the extent that I'd be happier without Nimoy. But, Nimoy is in the movie because his character is alive, Shatner is not in the move because his character is dead. To dig up Old Kirk with some contrived plot to explain how he didn't die after all, despite being buried and everything, would just be a dumb stunt. It was bad enough bringing Spock back.
Kirk is dead. He's not alive any more. Khan is dead too; he's not alive, and he can't be in the new movie for the same reasons as Kirk. There are many dead Trek characters who won't be in the new movie, again for the same reasons as Kirk. Their un-aliveness prevents it.
Kirk is dead. Therefore, not in the movie.

Or a Fight Club-esque single-frame shot of Shatner randomly placed somewhere in the movie.

Anyway, this is a non-issue all around. All the general public want is a movie they like, canon or not, with or without William Shatner.
