Well, half of it is. The recruitment mission isn't, and I think there's some other dialogue that wasn't shipped with the game either. But certainly enough to belie Bioware's claim of it being developed post-release.It *should* have been free with any new copy of the game like the Cerberus network stuff was for ME2, but EA just got greedy. IIRC it kicked up quite a stink when it was found that the DLC is actually on the disc as sold.
On PC it only requires an INI file tweak, not any "cracking". It shouldn't get you banned from SP, but it might from MP.Legally speaking, I think if you can crack the encryption you're fully entitled to play the content in the disc you own...but you'd probably get your account banned from Origin & BSN.

Zaeed's free with purchase of a new game, so I'm willing to let that slide.Indeed, I'm pretty sure it was the same with Kasumi and Zaeed. I think there's even trace remnants of both Kasumi & Zaeed's original recruitment missions in the main game files, in the form of unused dialogue. Same for Lair of the Shadow Broker.
That does seem to be what happened. Geoff Keighley's "Final Hours" app includes references to that squad member having been planned but removed.Without getting into spoilers; I suspect what happened is that they initially planned to have this character at launch, but back when they shifted the release date they realised they didn't have the time. However, rather than do what they said they did which was do *all* of the dev work for the DLC during the certification period, they pre-planned this to be DLC and laid the ground work during the main production period.

Supposedly there's some unused dialogue from Lair in the base game, but while I've found lots of references to it online, I haven't actually found anyplace quoting it. And from what I gather it was actually unused by the final mission (there were substantial changes), unlike Kasumi/Zaeed where it's verbatim.
Zaeed had a better recruitment mission, so IMO he still wins on content. The issue a lot of people seem to have with 'From Ashes' is that in terms of content, there really isn't that much to it. Just a fairly short mission in what feel like a MP map and a few conversations scattered throughout the game...which I suppose it a *technically* more than Zaeed had, but not by much.
...okay, fine, technically you're right. I was thinking of his loyalty mission (which doesn't really apply to the structure of ME3).His recruitment mission was walking up to him and telling him "Welcome board."![]()
