Presumably West Point has been subsumed into the general Earth forces by this point.
Not necessarily. We know that the UK still maintained its military in the 2150s, the Royal Navy is frequently mentioned in the present tense. Maybe that's what the MACOs were, a United Earth military with personnel pulled from the militaries of Earth's various nations. Hayes being from the US Army could explain why he had the American Major insignia on his uniform, the MACO uniforms allow the person to use the rank insignia of their native nation. It's either that or we accept that for some reason United Earth's military is using American military rank insignia.
 
...After all, the whole quadrant is using USN rank markings later on. Which shouldn't be that much of an issue because most of the planet today is using old RN rank markings, including the USN.

Or it was a special forces unit from one nation's military, deployed to the NX-01.

Patches can be swapped pretty easily.
 
Although TrekLit has Mackenzie (eventually promoted to MSGT) be 'in command' of the MACOs until the arrival of Major (later Lieutenant Commander) Kimura, my reading of Hayes suggesting Mackenzie was (mostly) as Reed's advisor on MACO personnel and tactics (because she 'knows the squad (better than Kemper?)) with the notion that Reed would be the O-i-C for both the Armory and MACO teams until a replacement officer could be provided.

Does that make any sense?

Oh so the MACO's do eventually get a replacement CO then, that was the other thing I found odd was season 4 never replaced Hayes. Was this in one of the books? and if so which one?

The Good That Men Do, AKA TATV Re-written establishes that McKenzie did indeed succeed Hayes as CO of the MACOs, so I guess she was promoted over Sgt. Kemper for some reason.
 
One would assume Hayes would have zero need to appoint a successor: there would be a system in place for that, removing all ambiguity. Whether the next step down the command hierarchy was unseen Lieutenants or largely unseen Sergeants, the seniormost among those would automatically become Hayes' successor.

Suggestions about Corporal McKenzie would then relate to something non-automatic, such as internal reshuffling among peers.
