This is what they have to say about that (from one of the reddit-pages):
"Dan Govier here, one of the project leads. Truly appreciate everyone's concerns about this being "another Stage 9", it's an understandable conclusion to jump to. However, I just want to make it clear that while we don't have a license (yet), we have spoken with Fox already and they are well aware of the project. We didn't want to do anything without speaking with the show runners first. Lessons learned and all that :)"

So far, Fox seems to be okay with it.

Was this before or After Disney took over. Isn't Disney more strict with their property than most corporations?

No, so far they've made FOX aware of it, and FOX has decided not to take any action...if FOX were explicitly okay with it, they COULD have granted a temporary license/waiver of some kind (and they still could). That said, just because FOX hasn't done anything as yet, it doesn't mean they can't or won't. Time will tell.

In the end though I hope these guys are successful, and they do manage to make some sort of real/legal deal with FOX.

It is being aired on a Disney subsidiary, but is still owned by the independent FOX that was left after the merger. IIRC.
 
Yeah, I don't think Fox owns any shows or movies anymore.
I ended up on the Twitter feed of one of the people who works on the show, I can't remember if he's a writer, producer, or both, and he actually Tweeted about this. So apparently at least some of the people who make the show are aware of it.
