Alec Peters used to assure people that CBS was okay with Axanar...This is what they have to say about that (from one of the reddit-pages):
"Dan Govier here, one of the project leads. Truly appreciate everyone's concerns about this being "another Stage 9", it's an understandable conclusion to jump to. However, I just want to make it clear that while we don't have a license (yet), we have spoken with Fox already and they are well aware of the project. We didn't want to do anything without speaking with the show runners first. Lessons learned and all that"
So far, Fox seems to be okay with it.

Fiar enough.I guarantee whoever had to say so did not give them an OK. More likely it was a "ask for a single dollar during this process and we will end you".
No, so far they've made FOX aware of it, and FOX has decided not to take any action...if FOX were explicitly okay with it, they COULD have granted a temporary license/waiver of some kind (and they still could).
