Agreed. The judge repeatedly mentioned that the comparison the Court was going to draw was between the Star Trek Copyrighted Works and the Axanar Works. That's a huge victory for the Plaintiffs, and for the rest of us who will not have slog through six hundred pages of expert testimony about whether or not the funny triangles on "Kharn's" costume in Prelude to Axanar are exactly the same as the funny triangle's on "General Chang's" costume in Star Trek VI.IMHO, the most illuminating line of the Denial is the following:
In other words, the judge has given a clear heads-up on how he will be approaching this case. We’re not going to be arguing over nitty-gritty details of whether the Four Years War was actually shown in TOS, or whether the Axanar emblem is distinguishable from the chevron shield. The inquiry is going to be a much higher-level “does Axanar copy the big-picture copyrightable aspects of the Star Trek universe - setting, ‘look and feel’, mix of races and species, and so on.” The fact that, for example, it contains new characters and story points is not going to help much if those new characters are peaceful logical Vulcans, warlike Klingons who speak a unique language or noble captains of starships that fly the flag of the United Federation of Planets and are clearly modeled after those in the Federation fleet. This approach to framing the inquiry is a big win for the plaintiffs.

And here I was awaiting a submission to the court from the Funny Triangles Society of America upholding the right to wear whatever triangular strangeness they wish.six hundred pages of expert testimony about whether or not the funny triangles on "Kharn's" costume in Prelude to Axanar are exactly the same as the funny triangle's on "General Chang's" costume in Star Trek VI.
I'm not pro-Ax or con-Ax, but what a dumb, specious, retroactively hypocritical thing to say. Far be it for me to tell you how to spend your own time on this legal issue of all things. Why not spend it on, oh, I dunno - anything else like reporting on all of those more worthy issues to which you ask Axanar supporters to contribute. And, by the way, they could do both, but like you, I'd prefer all the attention elsewhere. They might not come with the same immediate rewards and attention Axanar is providing you, but I agree they certainly are much more worthy of your obvious passion....PS hiya Axanar supporters - 'cause we know you're reading this topic - at some point maybe, just maybe, could you put your crowdfunding discretionary income towards things like, oh, I dunno -
Far be it from me to tell you how to spend your own money - you are presumably competent adults. All I'm saying is that there are many, many worthy causes out there and while they might not come with nifty patches, they could use your heart, your soul, and your obvious passion.
- helping fund the search for a cure for cancer
- founding a scholarship for students in need
- supporting your local homeless shelter
- buying blankets and kibble and cat litter for your local animal shelter
- cleaning up any local polluted waterway
Thank you for reading.
The Court wouldn't accept their Amicus Brief because the State of California doesn't allow legal documents to be folded into triangles. And here I was awaiting a submission to the court from the Funny Triangles Society of America upholding the right to wear whatever triangular strangeness they wish.
Ah. I see you skipped the "passive" part of "passive - aggressive". Classy.I'm not pro-Ax or con-Ax, but what a dumb, specious, retroactively hypocritical thing to say. Nice piece!
Though I don't see the point of talking about "work for hire" in the Okrand context.
WfH doesn't affect the copyrightability of something. It affects who owns the copyright.
One problem with your frog story --- it's too similar to the Aesop's Fable "The Shepard and the Lion", which is in the public domain. Someone might be able to challenge the validity of your copyright.

I don't have the time to think it out right now, but this comment on that comment is ironic?I'm not pro-Ax or con-Ax, but what a dumb, specious, retroactively hypocritical thing to say. Logical fallacy of false dilemma. They can handle more than one cause at a time, and probably do....maybe some of these people who continue to support Axanar blindly might want to consider other causes that could really use their attention and energy more.
Irony is my speciality. And if it is an ironic post, there's still something to learn there; the message is the same.I don't have the time to think it out right now, but this comment on that comment is ironic?
Yep. The lesson is: don't be a dick. And if it is an ironic post, there's still something to learn there; .
This...coming from you?I'm not pro-Ax or con-Ax...
Why do you waste your time here? All you do is complain. It is all you do here. If you don't like this subject, if you don't like what people are saying, if all you can do is incessantly berate and belittle everyone else in this thread because it doesn't meet your nebulous standard of right and thoughtful behavior, why post here? Why must you insist on being THAT person who has to make a negative comment every time? Why do you insist on making everyone else miserable?I'm not pro-Ax or con-Ax, but what a dumb, specious, retroactively hypocritical thing to say. No. It is that my failings are easier to see and acknowledge than one's own.Yep. The lesson is: don't be a dick.
If I've given any impression that I care about Axanar and the various actors in this unfortunate growth industry, mea culpa. I don't. I do care that so much worthless and self-important attention is spent upon it, so that's where I spend my time on pointing it out. Ironic? I enjoy irony.This...coming from you?
It's like someone saying "I'm not racist but..."

So let me talk this through... you waste your time telling people that they are wasting their time? No. It is that my failings are easier to see and acknowledge than one's own.
