CBS/Paramount sues to stop Axanar

One thing I never understood is how Axanar can even argue over the nitty gritty.

Even if the judge agreed to look at whether details were exactly the same, the name of their film was advertised and marketing very clearly as STAR TREK: AXANAR.

I don't care if your movie is about a frog and a boar becoming friends, if you title a movie STAR TREK you have a big problem.

EDIT: unless i'm thinking about Trademark. Not sure anymore it's all a blur!

Why not? They believe they're making the best case they possibly can in their own self interest. They'll use any avenue the law provides, including pro forma motions to dismiss. That's what lawyers do; that's what everyone does. How is this a surprise? Guilty people don't say they're not guilty because they believe it. They say that because it's just a rote term that's part of the process - a checkbox.
...There's nothing on the board that we discuss that's too important in the long run. It's entertainment....
I've made this point as the page count grew to extraordinary proportions, mostly to suggest we're spending too much time and obsessive attention on something that's just entertainment - like the OJ trial. It was countered by more prolific participants that this thread is contributing and having a direct effect on the legal case itself.

Not similar enough. The key parts of it were the disparate elements like main character being a frog, with a missized tongue, being ostracized and looking for peers who will accept him.

It's not the concept, or really even the story that someone enforcing their copyright would be looking for. But some specific elements.
In your example, you suggested that changing the boar and pebble to a bear and thorn isn't substantial enough of a change to avoid copyright infringement. (Sudden thought ... see below.) I presume you mean this would be the "specific elements" you'd look for to defend your copyright. Both the boar and bear would be dangerous animals that were tamed by removing a painful pebble/thorn from its paw, just as the lion was in Aesop's fable. As you said, the shepherd wasn't ostracized in the beginning like your frog was, so your story shares only that part of the plot device. You'd probably win in court if someone challenged your copyright, but there IS an argument there.

Sudden thought: There is a myth / urban legend that if you change at least two elements as you copy someone else's work, it's "different" and therefore doesn't violate their copyright or patent. It's a totally myth and has been disproven more than once in a court of law.
 
I'm not pro-Ax or con-Ax, but what a dumb, specious, retroactively hypocritical thing to say. Far be it for me to tell you how to spend your own time on this legal issue of all things. Why not spend it on, oh, I dunno - anything else like reporting on all of those more worthy issues to which you ask Axanar supporters to contribute. And, by the way, they could do both, but like you, I'd prefer all the attention elsewhere. They might not come with the same immediate rewards and attention Axanar is providing you, but I agree they certainly are much more worthy of your obvious passion.
You're starting to sound like those Gamergaters who love to loudly profess their neutrality and claim they know virtually nothing about Gamergate because they think it gives their opinions some kind of additional authority as an outside observer. But then when you spend more than a minute arguing with them about the matter you realize they're more bitterly entrenched and fanatical about the subject than most.

You seem to have an awful lot invested in smugly pontificating about this for someone who claims to not give a damn. It would be preferable if you at least dropped the BS facade of neutrality and detachment, because I know you can't rid yourself of the pompousness and pedantry.
