CBS/Paramount sues to stop Axanar

I can understand wanting to delete one's account... however I do agree with you. It's doubtful anyone was forcing him to come here. He could have just disappeared and never come back.

I'm rather new to TrekBBS (even though my account is a few years old) but I actually find it pretty reasonable here. I don't feel like I'm talking to people who are unwilling to keep an open mind.

I've been in touch with Tobias Richter. When he asked "how do I delete my account?," I think the TrekBBS forum Admin can be forgiven for thinking it wasn't just a theoretical question on Tobias' part and that Tobias wanted an Admin to jump in and, well, delete the account. The downside of that, Tobias learned after the fact, is that an account deletion implemented by an Admin is called a "banning"--which, in this case, is indeed a bit of a misnomer; he wasn't actually banned. Tobias seemed concerned that the account deletion was not labeled as "Account Proudly Deleted at User's Request to Formally Express Dissatisfaction with Board's General Tone Lately." He didn't seem to understand that an account deletion implemented by the Admin even at the behest of a user is called a "ban"--regardless of the underlying reason for deactivation. I expressed my regret that the board functionality cannot describe an account deactivation as anything other than "banned." (Sorry, Tobias.)

Although he had been announcing on his FB page that he was "banned," (technically true I suppose, by virtue of the Board's descriptive weaknesses), the bigger picture is that his account was deactivated at his request--as sort of a "soapbox"--just as others here have suggested. (People can simply never come to TrekBBS anymore if they don't want to participate anymore. How hard is that? And, of course, if he really wanted simply to know how to delete his account himself, or even if he actually did indeed want a Mod or Admin to intervene and delete his account for him, he could have simply sent a PM rather than doing it out in the open, in public, on the Forum. (I think doing it publicly out in the open on the Forum was probably his soapbox-y point.)

At any rate, the offer was extended to Tobias to reactivate his account if he doesn't like the implication of the wide-of-the-mark "ban" title. He can keep his account and then simply never come here again if he would like. But he confirmed that given the choice between an account that he simply never uses anymore and account that has been deactivated with the title of (somewhat of a misnomer in this case) a "ban," he elects to be saddled with the "banned" title--as erroneous as it actually is. He was insistent that his dissociation from the TrekBBS board be displayed and visible--above and beyond just "I don't want to go to the TrekBBS board anymore." I guess I understand Tobias feeling ostracized: as a key Axanar participant--likely one of the "John Does" if it ever gets to that--I think he just feels outnumbered here. His last post on the board was actually way back in August--and he has never issued a complaint about any board members' posts. Fortunately or unfortunately, posts that are "dark" or even "hateful" are not inherently against the board's policy. I think he might be expecting people who hold a contrary position to him to be sanctioned somehow--or maybe to have any posts that aren't glowingly supportive of Axanar to be deleted--just like they are everywhere else. As an elucidating point, our STNV 2015 Kickstarter raised $50K. Among one of the donors was "Axanar Productions." We recently refunded the minimal donation back to that donor (in the same way that a political campaign might refund money from some supporter when the campaign would rather distance themselves from that supporter). I hesitate to try and characterize Tobias' reaction to our distancing action but he seemed to me to be, well, incredulous and upset/disappointed.

Like any other place (notably on FB), I think passions run high on the Axanar issue. But more than any other place, this board has both supporters and detractors, of course. If it skews a bit (a lot?) towards detractors, it's understandable: detractors get their detracting posts deleted by Mods and Admins at a lot of other boards, and I think this Board might be one of the few places where detracting posts aren't automatically deleted in some knee-jerk fashion. I like to think detractors (and supporters for that matter), do get a relatively safe haven here.

I'm grateful that after 10K+ posts and 500+ pages in the Axanar thread, there has been only one complaint with one infraction issued. As passionate as people have gotten, everyone seems to be adhering well to the minimal board rules. You all have my thanks for both your passions and your politeness.

Especially since he is involved with an officially licensed project right know. He has done/is doing the covers for the first officially licensed German language ST novel trilogy to be released later this year.
He's done loads more than that. These are his ship models in the commercial for the Star Trek: Rivals game.
I've been a fan of Tobias' work since his old shareware Amiga Star Trek game. I spent countless hours playing that as a kid.

If enthusiasm and strategy were considered wrt/ bacteria, Continues would be probiotics, and Axanar would be MRSA. Both are happily doing their thing. Its the strategy with respect to the host that makes one healthy and one a disaster. Those who joined Axanar out of enthusiasm need to recognize the nature of the business strategy they were sold, and that it has nothing to do with their "support the franchise" enthusiasm.

Here are a couple of links about Tobias Richter bitching about not getting paid for his work on the fan film Star Trek: Titan back in 2014 and had friends spamming them to get him paid. I remember Gabriel Charles Koerner posting about it for him on his own Facebook page too around the time. So clearly Tobias Richter did Star Trek out of "love".

'Star Trek: Titan' project will not pay their contracted CG artist (the producer of their only actual content)

The parties are reminded of their obligations to disclose information and confer on a discovery plan not later than 21 days prior to the scheduling conference, and to file a joint statement with the Court not later than 14 days after they confer, as required by F.R. Civ.P. 26 and the Local Rules of this Court. Failure to comply may lead to the imposition of sanctions. Plaintiff's counsel is directed to give notice of the scheduling conference to each party that makes an initial appearance in the action after this date. Not later than 5 court days prior to the Scheduling Conference, counsel are ordered to confer and electronically file (joint) Form ADR-1 (and proposed order, Form ADR 12), selecting one of the three settlement options available. @GSchnitzer, thank you for elaborating on the situation with that informative post. It's unfortunate that Tobias is being so immature and petty about this, especially given the general conduct and marching orders from Peters. I think anyone who has followed this story will easily acknowledge that Richter's work on it has been superb. But his idea that negative posts should be deleted solely because they are negative is ridiculous. Nobody had any trouble posting negative things about the Axanar detractors before all of this. Surely he must see the irony?

In any case ... it sounds like you have done a fantastic job of making the situation clear and giving us all an anchor point to refer to if it ever comes up again or if he tries to play the victim elsewhere.

I didn't make this, just saw it on FB but... hilarious:

Thanks for the heads up Neil - I've d/l'd the order and the accompanying two forms. Probably won't blog about them as there isn't a lot to say, but I imagine we'll at least mention them on tomorrow's show.

Don't know if it was posted to reassure potential contributors in the wake of the Axanar debacle or if it was throwing some shade at someone who's attacked them in the past (I suspect some of both), but I loved this bit from the STC Indiegogo campaign webpage:
Our producers have never drawn a salary, and they never will. In fact, executive producer Vic Mignogna personally funded the first episode and has put nearly $150,000 of his own money into the series. Co-executive producer Steven Dengler has contributed over $100,000. Our co-producers donate their time -- some working hard every day of the year on various aspects of the show -- simply because of a deep love for Star Trek and for our STC family!

We seek no return other than the joy of paying tribute to TOS -- both in the creation of these episodes, and in the privilege of sharing them with beloved fans.

Trek Continues Inc. has an application pending for 501(c)(3) status with the IRS, which can be viewed here. Additional information may be found on our website.
