CBS/Paramount sues to stop Axanar

Perhaps ironically, JJ Abrams is also a student of the whole 47 thing; if you watched Alias, it was all over the place.

Back to the awards: I'm reminded also of the awards Axanar paid for about a year or so ago, the tacky ones where Peters couldn't resist having each award made including a line giving themselves credit for paying for/making the awards. Given that these were paid for with donor funds, it seems likely that most of these film festivals Prelude was submitted to, and at which they won all these awards, likely had entrance fees, some of which are not cheap. Its likely that, much as with everything else Alec paid for with donor money (the studio, lights, carpeting, phone bills, sushi, Alec's car, RMB's bar tab, Cash Markman's fundraiser) this too would seem to be at least one other area where Peters spent donor money.

And while public relations is a good thing and promoting your project is a good thing, and even using production money to do so is perfectly acceptable, at a certain point, when you're spending more time living off donations and traipsing from convention to convention to promote the short film that exists because of other people's talent and skills than actually getting shit done, you stop hocking your wares. For all their bluster about professionalism, Peters and Burnett essentially got nothing done.
 
I like to go back to the concept of a "faithful steward" - in this case a steward of the funds donated to Alec with the express purpose of supporting the PRODUCTION of a feature length film and funding the studio he chose to build as a shooting location.
Was Alec a "faithful" steward of those funds while he was traipsing around the country, eating, drinking, and luxuriating on the donor's dime? Was he a "faithful" steward of those funds when he was shelling out money so that he could win yet another useless award?

One could observe that film festival awards do almost nothing to advance a fan film. The only thing they do is advance the career and egos of the staff and the likelihood that their business can land *professional* projects which they run, not just house.

And that the awards are for the prelude, a teaser... this helps even less. Did the awards help raise donations? It seems kinda unlikely; fans want their Trek and don't need an arts festival to convince them. Only to establish trust in the project would it really be useful among donors. 47 awards worth of trust bolstering sought out, for some reason.

And look how that went.

I asked Mike Bawden (Axanar P.R. rep.) if he is being paid with donor funds. He answered he isn't, his services are free but later it turns out he's been promised a stake in the studio as compensation and he's one of the "secret" studio investors.
Ah. Has this now been made public, and if so, do you know where I can read this myself? Thanks in advance if you do. The last information I've known about is from the public statement from Mr. Bawden:

Oh. I didn't see this one coming.
NuDiana denied having any involvement with the studio yet it turns out she has a studio position.
Same questions as above re Mr. Bawden: How did we learn this & where can I read about this myself?

I know it was learned that the defendant is A we'llnevertell investor when he offered Mr. McIntosh a share of it. I do not know how it has been learned that Mr. Bawden & Ms. Diana are also part of this.

Yesterday marked the end of discovery for the case. Alec Peters' second deposition concluded yesterday afternoon. Tomorrow at 2 pm is a followup conference call between the attorneys and federal magistrate judge Charles Eick.

Guess we'll know soon if the second deposition moved CBS/Paramount either closer to, or FARTHER away from a settlement offer soon.

(Although given Alec Peter's ego, I'm inclined to believe he'll decline any/every reasonable offer - assuming CBS/Paramount ever really made one.)
 
In other news, Fan Film Factor blogger Jonathan Lane early this week started a $45,000 GoFundMe campaign to pay three months' rent, utilities and salaries at the Axanar studio. Titled "We Stand With Axanar," here's his pitch:

Already, Alec has put more than $150,000 of his own money into "keeping the lights on, but he is nearly out of money now. I wasn't supposed to tell you that.

Lane insists he did this without Peters' knowledge. As an independent crowd fund, controlled by Lane, this new money would very well lie beyond the reach of any damages or monetary settlement from the lawsuit.

Take from that what you will.

As far as I can tell, Mike Bawden and NuDiana's status as members of the investment group is just speculation and assumption, so I haven't reported this.

The only actual facts in there are that Mike said his position as PR director is volunteer and NuDiana is listed as the marketing person on the Industry Studios website.
