Case dismissed! Discovery and Tardigrade game "not similar"

I agree and like I said he’s also basing some of his frustrations on things he planned to do but we’re not in any published material.

And that’s exactly it!

Back in the early 1990s, I wrote a Star Wars fan fic of a female Jedi being adopted into the Skywalker clan. Other characters included a young hotshot pilot and someone who was romantically interested in the female Jedi. If I was going by Abdin’s perspective, I could have sued Disney for stealing my idea. Nevermind the fact that I was borrowing copywritten characters from LFL, nevermind that I couldn’t copyright it or truly publish it, nevermind the fact I was only 14 when I wrote it and it was really, really bad. ;)

The truth is, Abdin never had published his game. He never even finished it. If I recall, he didn’t even copyright it until after the whole thing gained some traction in the fan community. (Not that the copyright matters necessarily.) But Tardigrades was a work in progress. It still technically is. Abdin gave us some glimpses into his plan, but you can’t sue for copyright infringement for what’s in your brain if you haven’t put it all on paper.

There are some superficial similarities between what we’ve seen of Tardigrades and the entirety of Star Trek: Discovery. But that’s just it: they’re superficial. If Abdin’s published material had something to do with a Tardigrade that was able to be plugged into a computer and navigate the galaxy at speeds faster than light, I would be more likely to believe that this was fishy. But instead Abdin has his Tardigrade hug. And we’ll, the only characters who ended up getting close to Ripper got mauled, so... not really the same thing.
 
The steam page though, hasn't been updated since 2015 according the page itself.

But I'm not sure what it tracks as an 'update', since there was a post made a month after the last one.
From what I can tell, STEAM doesn't seem to indicate with a time stamp when or if a blog has been altered by the owner. (at least it's not obvious to the reader)
One would have to have seen the original blog and remember it's context.
In this particular case though, it's quite obvious because the original blog that brings in the concept of the Tardigrade, was about halfway through his posted design concepts.
Yet almost all of the earlier entries have now been changed to include the creature in some form.
(either a mention of it or his current logo)

No it won’t. I still don’t expect anything more then he loses though. Court won’t be happy but don’t see any fees or fines being given to him.
If I remember correctly, I believe that he talked about having to come up with the original $400.00 to file the case.
That is a lot of dollars for some folks.

What about the Wayback Machine? Anyone try it? I know its not always perfect for stuff like this but it may bring some more evidence in regards to this.

It's not particularly telling in any way, shape or form, unfortunately.
 
yeah I posted using the Wayback machine last page. Some of the images are newer than 2015 though, if you open them in a new tab the date they were cached is in the URL, most of the images with the logo were updated October 2017 or later.

The actual page text should still be from 2015 though
 
It's clear they ripped him off is why. I had a script that was plagiarized and I did nothing, it's a hard case to win; but I wish I had, now. I'm rooting for him! He should get a fair hearing. I hope he wins!

Is it clear? Like, the one thing he has (which is the tardigrade hugging sequence, which in itself probably doesn't even make the cut as a protectable "expression of an idea") wasn't posted on the net anywhere until Discovery was already filming it's Mirror Universe episodes, so long after Ripper came and went on the show.

Everything else he claims was ripped of is either inaccurate (like claiming that Discovery copied his blue uniforms with colored parts to show rank or division which he says never appeared like this on Star Trek before, which ... Enterprise?), deliberately misleading (like basically making a composit of three different characters of his and claiming that it's the basis for Stamets, or putting two originally separate sequences together to make them appear more similar to Discovery), to the most pathetic grasping of straws ("I have a black woman and a red headed woman! My gay character has a beard, too! Theft!!!).

Does that work in reverse? Is disbelieving him a pro-Disco bias test? Anyway, as I said, I got ripped off once, I know how it feels, and I think he has a case and I hope he wins if he makes a good case.

And STD stinks. Sorry, been a Trek fan since '79 and I honestly think it's junk. Live with it.

Why do you think he has a case? What information are you basing this on?
