Case dismissed! Discovery and Tardigrade game "not similar"

Ah wait, I was wrong, his original Steam trailer (titled Tardigrades) was uploaded in 2015. It does have a tardigrade in it, but it's never standing next to any people, so we don't know how big it is.

The first appearance of it next to a human wasn't until 2017 as far as I can tell from my research.

He changed the name of the game to Tardigrades in 2015, at least according to a blog post made that year.

But you are right, it was originally posted as Epoch on steam.

Dude was first. That's why he's so pissed.
But he wasn't that much first that CBS could have stolen the idea from him - because production for an episode lasts longer than two month - they were already working on Ripper behind the scenes before Abdin premiered this trailer.

Then he has no reason to be pissed as it is obvious nothing was stolen from him.
 
Indeed. But I also definitely have sympathy for the guy - he was first, and then felt robbed of his idea. Completely understandable. Doesn't give any merit to his court-case though.

I agree and like I said he’s also basing some of his frustrations on things he planned to do but we’re not in any published material.
 
His case is apparently built on the supposed fact that someone saw his presentation on STEAM.
Not that they saw anything on Youtube.
That is what his lawyer has indicated in the writs to the court.
And is why they wanted access to DISCOVERY Production Names and Data from the Valve Corp.

I'm simply pointing out that based on my knowledge of his original STEAM presentation, that was not possible.

There’s a huge burden of proof on him to prove that. Because it honestly comes off as completely absurd that the production design department of Discovery was trawling Steam for ideas for a creature when the legal department won’t let them use certain names because a real person has it and that could get them sued. BSG had to change Col. Tigh’s name from Paul to Saul because of such an issue.

I agree. I also feel bad that the haters making him think he had a chance.
It’s going to end up costing him a lot of money unless CBS is in a forgiving mood. I doubt the haters will be chipping in though. Because they only care about hurting Discovery for some stupid, childish reason and not protecting this guy’s intellectual property.

But you are right, it was originally posted as Epoch on steam.
And just about all of his blogs have been back edited to either include the tardigrade and/or his tardigrade logo.

He did the same with video Thumbnails from before the name change, though they all still say Epoch in the video titles.
 
CBS’ lawyers could use that against him. It was really a dumb move. Now he looks like he’s trying to scam them for a settlement.
I think they mentioned that in the motion to dismiss, and that he went back and edited together stuff that originally didn't go together, or took stuff out of its original context, to look more similar to what Discovery was showing.
 
Regardless, the timeline doesn't add up. Hopefully the judge will end it soon and let the reckless speculation on how evil CBS prevailed over the little guy be funneled in to other hateful venues.
 
The steam page though, hasn't been updated since 2015 according the page itself.

But I'm not sure what it tracks as an 'update', since there was a post made a month after the last one.

He is likely to lose. I doubt he'll be out any money since I expect the lawyers took this on contingency so the lawyers are out.

Abdin will have a bruised ego and when/if he ever releases his game there will be some who think he is the one who took the idea from DSC (and that I think is the main reason for the lawsuit). However on the other side if he does release it he'll have the DSC hater people hyping it up a ton as the "game so good DSC stole it" so in the end I expect any effect on sales would be a wash.

However, my overall prediction is he loses, his lawyers lose money, and because of the loss never actually finishes the game.

If he actually edited blog posts to make it look like he came up with the idea earlier that's not going to go over well in court and it's easy to check.

No it won’t. I still don’t expect anything more then he loses though. Court won’t be happy but don’t see any fees or fines being given to him.
