Off course, not all of them need to appear in costume/uniform...

Until they cast an actor and make it more official he's not yet in the movie according to their press release as posted today. We know they intend for him to be in there, it's just not officially official yet.

So happy about General Ross, been saying for a while it would be cool if they could bring either William Hurt or Liv Tyler back, esp to make TIH feel more part of the mythology than the lonely step-child it's kinda become. So I'm really glad this has finally happened.

It's not addressed one way or the other. My take is that he's as much off the grid as Coulson is. Just as there are quite a few people who know Phil Coulson is alive, it's not like he's advertising the fact. Likewise Fury stepped may have stepped out of the shadows again, but I don't think anyone outside of SHIELD or the Avengers Initiative know he's alive if they didn't already.
It's also worth remembering that neither of them were exactly public figure to begin with.
