Brian Brophy didn’t return?

Maybe they should just have addressed it in dialogue, especially as it would fit exactly into the plot even.

Picard: Maddox, you don't quite look how I remember.

Maddox: Hey, if you were hiding from the Tal Shiar and the Zhat Vash and traitorous Federation spies you'd get cosmetic reconstruction too!

Picard: Oh, good point.
 
I'm sure there were articles in the "trades" about this show being in the works. If Brophy had been at all interested in returning to Trek he would have had his agent (does he still have one?) looking into it. The fact that he was unaware of the character being used, according to a report on this BBS, tells me that it was not at all on his radar.

And maybe, just maybe, Brophy just doesn’t give a crap about Star Trek, and his role as Maddox was just something he auditioned for because he needed money at the time. So why would he reprise a role he probably doesn’t even remember anything about?

Even if Brophy were a passionate Trek fan, why in the world would he think he'd be appearing in Picard just due to one episode he did 30 years ago? He had no more idea of the plot than any of us did at the time. Calling his agent would be absurd when even TNG main cast members were saying they didn't know anything about the new show.

Even Ricardo Montalban was surprised to be called back as Khan.

Why? I'm a big Trek fan and I barely remember what Brian Brophy looks like (no offense to Mr. Brophy). There is simply no need to point it out.

Both Carolyn Munsters had more time without anyone noticing. Besides, that was probably one of Grandpapa's experiments trying to fix her sour looks.
 
I would have preferred if he reprised his role.

But he didn't, so it isn't a big deal. It's not like he was a major character. A memorable one and important one? Yeah. But I can understand why the producers didn't go that route when he has seemingly been retired for a decade. Hugh's actor is an active actor too.

If I remember correctly, directors were involved in casting the actors for the specific episodes during the Berman era. I don't know if that is still the case, but it is possible that Jonathan Frakes was in on the decision to recast both Maddox and Icheb.
 
Ouch sounds like he'd love to come back if asked

Guys in charge of Star Trek: “We read your Caltech transcript and we’d love for you to reprise that one-off role you had over 30 years ago!”

Brophy: “Great! That was my favorite role! I’d love to come back! I can’t wait to restart my acting career! Fuck this university and their low-paying wages!”

GICOST: “And since you’re already used to it being a one-off role, this part is also going to be a one-off, because you’re only in it for about ten minutes of screen time before you die!”

Brophy: “Er, what? You mean it’s not a recurring role? And I’m only in it for ten minutes and then you kill me off? Um, I have term papers to grade. Get the hell out of my office and stop wasting my time and giving me delusions of grandeur, you assholes.”
