I find it odd that Earth after being attacked more then a few months earlier had 0 ships in position to defend her if Enterprise failed in the mission. The only theory I can come up with is because time and space is so jacked up in shockwave that when they come out of here vortex it was already world war II time period.. but if this has been discussed earlier then never mind I just found it weird. but would explain when they go back to there own time the fleet is there wondering where the enemy is at.

I don't believe Earth had much in the way of forces at that time, a few dozen warp capable ships, and whatever number of sublight only ships. No matter how you deployed them, there would have been massive gaps.
With the first Xindi weapon, there wasn't much time between when it appeared, and when it fired. Given that, it would have made more sense to have sent the majority of Earth's armed forces into the expanse (at whatever speed) and not just the single fastest ship.
Considering the size of the fleet seen at the very end of the "Storm Front" two-parter, it makes no sense that Earth was undefended in "Zero Hour" (and the civilian space station the Xindi destroy means it HAD to be the correct era, and they only went to alt-WWII after the Clockwork Death Star's destruction) sooooo.... just one of those things. 
Even if the Xindi's vortex/slipsteam/whateveritwas travel to Earth was undetectable, once they emerged it would have taken 5 seconds for the fleet to warp over and open fire.

Enterprise's Starfleet, the Borg baby, and Nero's brow ridge.The Xindi popping up out of nowhere, right next to their target, would be an excellent argument for keeping all of Earth's space assets on relatively low Earth orbit. Including the interstellar ones, as they wouldn't be doing much good between the stars anyway.
OTOH, even low Earth orbit is a big place, and it might well take several minutes for the nearest vessel or craft to arrive. The only real problem here thus is that the fight did seem to take more than just a few minutes...
The fleet gathering to welcome NX-01 home would be a different matter, as it would have plenty of time to assemble even though NX-01, too, popped out of nowhere. When our heroes first emerge from the past, their screen shows Earth free of any visible starships, which is realistic unless those ships are at point blank range. Plenty of dialogue then follows, and only then do the welcoming vessels reach visual range.
Perhaps we could speculate that Earth analysts decided it would be a great idea to have a defense perimeter at distance X from Earth to intercept any emerging Xindi weapons. Too bad they got the value of X wrong...

I would tend to agree with you. If you went a step or two farther and read the books after the show ended, Earth was still trying to build up enough ships to defend itself in the Romulan War. There weren't nearly enough then, imagine a few years earlier when we were just starting to explore space finally.

Let's retcon it. They ran into a sopace anomaly and they were delayed.
Most of the Earth fleet ships were in space dock being upgraded and the rest were on deep space duty.
The second Xindi attack the Enterprise arrived to another time period, to alternate Earth. Remember they weren't picking up any starfleet activities and communication when had arrived to Earth. The only thing they were picking up a single space station in Earth orbit. Which the Xindi destroyed.

Our heroes recognize the single station as being part of their "regular" timeline, though. It would be a bit much to assume that a timeline exists where the Yosemite 3 station is readily identifiable, but the rest of Earth's space assets are radically different (that is, not there).
