So what there cannot be a a paralell Section 31 ?
. But the main villain won't be Gary Mitchell, Khan or Section 31.
Who shall it be?. But the main villain won't be Gary Mitchell, Khan or Section 31.

*gasp* ...perhaps somebody completely new? Or is that too much of a stretch for the Khansies or the Mitchellsies to contemplate?Who shall it be?

They were in the Laurentian system.
Remember that Kirk was able too take on Khan in a fist fight and win. That's how Kirk had beat him in the first place.
Kirk didn't beat Khan in a "fist fight" - he bludgeoned him with a blunt object.
Abrams is not about short-cuts, he likes doing original things.
Look at the similarites between Nutrek and SW.
H runs in black so i hope he is Section 31.
Section 31 brings with it a lot of messy baggage. I can't see them bothering. And if Section 31 have to always wear black, doesn't it give away that they are working for Section 31?
Abramverse is a messy universe with bars, barfights and slutty orions.

It amazes me that so many people here are trying to guess which TOS character Cumberbatch is playing, when there's no official word that he's playing a former TOS character. I would bet he's playing (gasp!) someone new we've never heard of before.
Especially when we all know he's playing John Sheridan.
Yeah, exactly like District 9 ripped off Avatar: Our guy joins a mission to forcefully remove a group of helpless aliens from their home alongside a psychopathic military guy, but throughout the film he gets closer to the aliens using a mix of the his human DNA and some alien DNA which enables him to gradually become one of them, and through their relationship he discovers there's more to them than he originally thought, learning the other side of the story. He gets accused of siding with the enemy as a result of violent alien sex, and everything gets wrapped up when in a fight between him and the psychopathic military guy involving a mecha exoskeleton.

Which he held in his fist.

I think that would be cool, but I already know who they are. The general audience would be confused and there's no time to explain things in a two hour movie.
They need an antagonist who is good to go right away, no explanations required. Not "why is Khan a white guy," not "why does Starfleet have bad guys in it now?" We need that time for fights and explosions, not boring blahblahblah!
As far as originality goes: I don't know if anyone has used red matter to create a time travelling worm/blackhole before?
If we're throwing Khan and Q around, why not Garry Mitchell? Its pretty much a story that could be retold better now that there's better tech to work with and its relatively early in Kirk's run as Captain?
