Well Sony can use the Peter Parker version. Because they own all the film rights to Spider-Man. Disney is basically leasing Spider-Man. The reason they arent using Peter Parker is more that people think if the character name as an adolescent. Ben Reilly isn't known to anyone that doesn't read thr comics so it was a good move. It gives the show a more independent feel now from Spider-Man.
Yup definitely a feel from movies like The Maltese Falcon and Laura and then with a taste of the old superhero serials from the 30s and 40s like Captain Marvel, The Phantom and Superman thrown in the mix. Im only on the wnd episode but its great. The best show ive seen in a long time. Nicholas Cage is doing a bang up job as the character. So far hes more pulp detective than superhero. I really like that.
