Benjamin Sisko was involved in the original development of the Defiant Class after the battle of Wolf 359.Considering the somewhat shady nature of the Defiant herself (with the Romulan-approved cloaking device), I would quite easily postulate that this started life as a S31 design. I'm taking into account how "un-Starfleet" many people perceived it to be when it first appeared on-screen. Perhaps it was not, in fact, a Starfleet design. When the threat of the Borg became the #1 issue, and finding common cause in mutual survival, S31 decided to share that design with Starfleet shipbuilders, who had more resources with which to build a whole fleet of the things, if they chose to do so. What did Sloan always say? "The ends justify the means".

I suspect he may simply have been tasked with generating functional requirements and mission profile use-cases from a tactical and strategic POV. Section 31 might really only have been there to give the nudge to sway the upper brass & the Federation Council that a more "Military First" doctrine needs to be taken if the UFP were to survive in the future.

I could very easily see some other Sloan-type character (or maybe it was even Sloan himself or one of his operators) popping into one of the planning meetings, having caught wind of the project, saying, "Hey! Look what I found collecting dust in an old filing cabinet. I'll just leave that right there." Sisko takes one look at the schematics and says, "THIS IS IT!" A year or two later, the first Defiant was born. Done and done.

If they were using up-dated old Section 31 ships, I could understand, but using existing StarFleet Design is likely to cause a unnecessary up-roar to anybody who might notice that vessel and confuse it for a StarFleet vessel.
You don't want people impersonating your equivalent of the Military.
So that means that Section 31 should stick to it's own "Unique Designs" IMO.
And Section 31's vessels were FAR cooler & Ahead of their time IMO than any design in the 23-rd century.
So I would want them to be more "Unique".

The first ship with “modern“ warp drive. There problem solved.The unfortunate truth is that when TAS was broadcast, the intent was that the Bonaventure was the first ship with warp drive installed. Despite it looking not all that dissimilar to the Enterprise, because the writers and animators had no idea about the history of Earth space travel, the formation of the Federation, etc. Honestly, in my opinion the best thing we can do at this point is to just ignore the line, since it's pretty incompatible with Trek history since then.
