Fuller didn't say there was a legal issue about using this design, what he said is that there was (potentially) a legal issue with commenting on its being directly inspired by McQuarrie's concepts. I'm just guessing but that might mean that if they say publicly that it's based on his design, then he'll have to be credited as a designer and receive royalties or something like that. It probably depends on what the terms of his agreement with the studio were when working on Planet Of The Titans, which may be what their legal team is currently trying to determine.And apparently there are some legal issues with using it which is a pretty big question mark
I do get your point, I don't agree 100%. Yes, people say it's ugly but that's based on a low quality render of a pre-production cgi model. Give this baby loads more detailing, better textures, better lighting, and it will look loads different. So, people are still hating because of a early glimps of the ship. As we move on, and see more, it might be different.
And as for it being hideous, that is all a point of view. It's based on a concept for the Enterprise for Phase2, and this design has been discused for decades now.
Some love it, some hate it. I'm guessing the same will happen with this ship over time. Some fans hate the Enterprise-D. Some think it's God's gift to spaceship design. Some hated it when it was first released and love it now, others loved it at first and don't anymore.
Some mentioned feeling a Kingon influence. However the McQuarrie design (and thus variant too) has always reminded me of the Vulcan IDIC symbol

Ignore the gray and red circles, look at the blue cut out circle. The proportions of the triangle and circle compared with the McQuarrie design is pretty much identical.
Yeah, maybe it is wishful thinking. I really hate to be negative, usually I'm very enthusiastic about new things in Trek. I loved the NX-01, I loved the Enterprise from Star Trek (2009), I loved the Kelvin and the Franklin. But this? This is the first Star Trek ship design that not only does nothing for me, but one that I actively dislike. I find it's way too boxy, out of proportion and lacking any kind of grace. I really really hope the end result will look much different than this. Yeah, but was that design released in an official teaser promo for the show?Maybe, maybe not. I definitely remember seeing the foamcore Voyager Prototype before the show came out. The design changed pretty drastically after that was revealed. (I just wish I wasn't several thousand km away from home so I could dig up where the prototype was revealed.)

Opinions aside, this design is not really new. It's a modified version of a concept from TMP. But we can split hairs over that all day.
There's a lot more tolerance for oddball designs as long as it's not the Enterprise.
