If the war was lost Picard would be flying around with the E-E putting out brushfires, welcoming munchkins, and stuff and not make much difference to them if there's an occupation or war or not.

Picard would never surrender. He would form a resistance. His character does not call it quits. Remember he laughs in the face of death.
