I always thought Season 4, otherwise known as the season of absolutely no continuity, should have included Archer on trial. Missed opportunity, especially because it's a tough call and because it unveils some good soul searching.

I like that he stole the warp coil. It's very unArcher-like and proved the desperation.

they were not stranded.
they still had impulse and it is possible another ship would look for them.

they also left behind not just food and other supplies but trellium that had a great deal of value within the expanse.

but yeah when your choice came down to doing this or lose what looks to be your only chance to save earth it is almost no choice.

Literally, the "any justifiable" part should mean that Archer could simply kill the alien crew and eat their remains if he considered it justified and conductive to the survival of his own crew.

The regulation is essentially meaningless until one defines "justifiable" in the particular circumstances. No doubt Janeway's rulebook included a few pointers for doing that defining, as well as quite a few limitations on what is never justifiable.

Wasn't there a TOS episode where Kirk declared that the crew could and should be sacrificed in order to protect the Prime Directive? Self-defense is usually high up in the rules of engagement of any military, but Starfleet would appear to be a bit different.

Well when you factor in things like General Order 24, the Omega Directive, we get a picture that Starfleet is not above giving Captains broad powers that amount to "Well you can nuke anyone you want to...so long as you have a really good justification"

So in Archer's case, he'd be on the low end of the spectrum or actions he could possibly have taken.

True, the aliens still had impulse engines but how far could they go before exhausting their impulse fuel?

Well they were from a warp-capable culture. So who's to say they don't start limping home and their home-system just doesn't jump out to give them a hand.
