Sherlock - Series 2

You can, if there are aspects of Sherlock specifically (as opposed to things from just the original Doyle stories) that are re-used in Elementary. Such things would include: Watson's leg wound being psychosomatic; Sherlock being a nicotine-patch user instead of a smoker; everyone's texts saying "WRONG!!" at the same instant; the entire way of illustrating Sherlock's deductions graphically with little arrows and bits of text and so forth...these are all elements of the show Sherlock specifically, and if used in Elementary could be grounds for legal action, especially since CBS (the network on which Elementary will air) once discussed doing an American adaptation of Sherlock with Steven Moffat.

Watson's leg wound being psychosomatic;
No big deal and almost necessary unless you want to do a Kerry Weaver(and even ER ultimately got rid of Weaver's bad led). The only reason Moffat came up with the psychosomatic thing was because didn't want to bother having Watson hobble up and down stairs beyond the first episode.

Sherlock being a nicotine-patch user instead of a smoker;
You can't smoke on network tv in today's environment unless you're a bad guy. You have to replace it with something and nicotine patches are the most obvious

everyone's texts saying "WRONG!!" at the same instant; the entire way of illustrating Sherlock's deductions graphically with little arrows and bits of text and so forth...
Those are just shortcuts to explain what's happening at the moment without having characters narrating, Moffat did not invent that.

I love Sherlock, it's a great series but it's a bunch of public domain characters and ideas that have been used many times before. The BBC will never be able to take legal action because except for the footage they filmed they own shit, nothing about the series is original.

Well, this Watson won't have a leg wound 'cause she's not even an army doctor! I have no problem with a gender-swapped Watson (though it would've been even cooler if Sherlock, too, was gender-swapped; and I think Lucy Liu would be a better fit for a gender-swapped Sherlock than Watson). I do have a problem with the fact that Watson is no longer an army doctor. She could just as easily have been serving in Iraq or Afghanistan just like any other Watson.

After seeing the preview, I do not think they have anything to worry about. It will be canceled by midseason.

Not the BBC, Hartswood Films, the independent production company owned by Steven Moffat's Wife and her family.

Probably not. CBS has a pretty good success rate when it comes to procedural shows. More than likely it'll be rather successful.

Since it's set in New York, how many episodes do you think it will be before someone yells at him "Yo Holmes"?

I don't know... there tends to be certain attributes that we associate with iconic characters such as Holmes, Bond and Kirk. This guy just doesn't feel like a Holmes to me. The way he talks and moves lacks the degree of confidence Holmes should have.
