I always got the impression the federation's penal system was pretty lax and comfortable.

Well, I'd say "pretty lax and comfortable" for the prisoners who line up without discussing the settlement and work! I'd add that, as ‎enchanting as the landscapes are and even if the work didn't seem too stressful (by the way, nothing says that Tom didn't take a break to cobble an old device when Janeway arrived ‎unexpectedly...), a prison remains a prison, full of people (prisoners, guards) not always well intentioned towards you ; with a well-defined regulations from morning to night ; rationed food (and not the best one) and no alcohol
etc... . Please, do not be fooled by appearances, mon ami! ;-)
-> I guess that those who are there, know the difference between their previous lives when they were free to do what was going through their heads, their present life where activities are ‎restricted and the one they would like to have when they come out from there, if they are quite lucky.. For Tom Paris, I'd say, plenty women/alcohol and enough money to cobble old devices/write holoprograms! :-D

Well, as an ex-military ADA became a civil lawyer, I'd say prisons (penal colonnies remind me too often, labor camps and dramatic memories in connection with our history!) and yes, they are a necessity to our society to remind to officers and civilians that there are ground-rules/protocols for the first and a constitution/laws for the second which are laid down for specific reasons and that they must be respected and followed. So,, all persons violating them, should not go unpunished, but always in a fairly way.
-> on a purely military point of view, disobedience to a superior, conspiracy and/or sleeping with the enemy are the worst grievances which can be lodged against against officers for me and requiring life imprisonment or death penalty as a maximum punishments for officers committing these violations wouldn't be shocked me at all.
For my part, I often advocated for the imprisonment for a long period and/or the dismissal from the Army when I was working for them.

Exactly, Tenacity & Prax. A stay in a penal colony is very far to be a sinecure. In fact, even in a very restrictive disciplinary framework, prisoners are left on their own .And I'm pretty sure that Starfleet must have the ones deemed to be the most difficult.
That's why I've said once or twice, that the crew of Val Jean had been damn lucky to fall on someone like Cpt Kathryn Janeway, who always treated them with respect despite their past actions and forced her (Starfleet) crew to do the same, AND Voyager, which offered them comfort and protection throughout the journey. I'm not sure that the members of the Maquis, who were captured and sent in penal colonies (on Earth) during the same 7 years, by Starlfeet, were able to say the same... .

Well, sorry to contradict you, Catarina, on this point but Krashykk was NEVER considered as an ennemy by Starfleet or even the Federation of the Planets, for the simple reason that neither of these organizations knew his existence! You cannot fear something or someone you don't know, right?! ;-) So, that Janeway yields to his charms or not, would not have any difference..., unless to have endangered her crew, her vessel or to have made decisions unethical to the Prime Directive and/or Starfleet protocols, under Krashykk's proven influence.

Maybe they're on the honor system. Maybe 24th century prisons have no walls, but humans are just so darn honest in the future that prisoners don't leave.

All in all I think Seven was in the right-if it was just one or two Hiorgen ships trailing them then Janeway would have a lot stronger leg to stand on but with six and on the verge of being destroyed? Seven made the right choice even if it was a regrettable one.

Yes the Species 8472 had been hunted for months mercilessly but as Seven said it forsook the right to fair and honorable treatment when it snuck on the ship and attacked Voyager's crew desperation or not.
