Is that a "porn parody" just to get around the guidelines??? LMFAO

Would a porn parody not violate the fan film guidelines?

The fan production must be family friendly and suitable for public presentation. Videos must not include profanity, nudity, obscenity, pornography, depictions of drugs, alcohol, tobacco, or any harmful or illegal activity, or any material that is offensive, fraudulent, defamatory, libelous, disparaging, sexually explicit, threatening, hateful, or any other inappropriate content. The content of the fan production cannot violate any individual’s right of privacy.

If we end up having a wider discussion about the above production, it might be worth starting a new thread.
 
From my understanding, parodies are protected in general, so all anyone would have to do is add a couple explicit sex scenes, call it a porno and no one could actually stop them.

(Then fans cut out the sex and stick a fanedit back on line somewhere. haha.)

No - Parody has been determined to be 'fair use' (In fact that was one of the Axanar Legal Teams arguments that "Prelude To Axanar" shouldn't be allowed as evidence (had the Case gone to trial) as it was (in their eyes) a 'Mockumentory' and this a type of Parody allowed via the 'fair use' claim.

So, if you make a full on Parody, you can do what you like with little fear of repercussion.
 
I'm sorry, but I fail to see how adding a bunch of R/X/XXX-rated scenes to a script makes it a "parody".

Where is the humorous, deliberate exaggeration? Where is the "comic effect"? Maybe my funny bone is broken, but I just don't see it. Ergo, to me, this is not a parody. And I made the same argument against calling Prelude a parody.

I remain convinced that these porn producers were not sued because the rights-holders knew the publicity of a lawsuit would actually draw more attention to the crap than anything, and ensure the videos flew off the shelves before they could be recalled.
 
Just about all of the "porn parodies" of things like the brady bunch, 70s show, scooby doo, wonder woman, etc pay close attention and tribute to the source material, surprisingly.

Probably true, but my point is I believe their claim to protection under copyright fair use law is invalid and disingenuous.
 
The trouble is, who is the arbiter of what is funny? Some people might find the idea of the TNG crew humping hilarious in of itself. Do judges then have to decide this in sort of a Jacobellis v. Ohio where Justice Potter Stewart's wrote, "I know it when I see it"?"

YouTube has just taken down EC Henry's channel which hosts the Pacific 201 trailers and clips. Hopefully it is just some bots working overtime.

Data is. I mean, he was able to ask the computer "Who is the funniest?" ;)

I remain convinced that these porn producers were not sued because the rights-holders knew the publicity of a lawsuit would actually draw more attention to the crap than anything, and ensure the videos flew off the shelves before they could be recalled.

It may also be the fact that the porn makers can afford better lawyers than your typical fan production. The copyright holders don't want protracted litigation. I saw the de-sexed version of the film in question and found it a surprisingly good story with, er, decent acting and good casting for the most part as the performers did resemble their TNG counterparts.
 
I watched the same one. It was on youtube. Its just a TNG fanfilm in that form. It has a teaser, storyline, act breaks, and resolution.
 
You watched a de-sexed version of a porno? Really, what is the point?

The point was to watch it as another fanfilm and evaluate it in that light. It was also a, er, hot topic of discussion around here at the time. My impression was pretty favorable. Unlike a lot of fanfilms, the cast had some acting ability and, due to their career, a certain familiarity with the rudiments of film-making.
 
Anybody got any updates on this one? I wound up on their fb page..........and their website redirects to some iPhone giveaway spam site for me now...........never a good sign.
