Eh, just throw his ass out on the curb. I mean how many warnings have you given this guy? Especially in this economy, people should be happy with the jobs they get and not try to break every little rule.
 
Tenure is a contract. Also, most places have employee handbooks that often spell out termination policies, and handbooks are often considered at contractual. Fire someone without following a company handbook even in an at-will hire/fire state has a good probability of that company losing a wrongful termination lawsuit.

Most companies around here have a phrase in the handbook reaffirming their right to fire you without cause at any time regardless of the situation. I got a couple of handbooks I've saved over the years I think I'll scan pages and post them.

Indeed... ingenuity. Hell, Kirk can burglarize a school facility and commit vandalism in order to beat a test and get a commendation for original thinking I guess that would make perfect sense. Yes, I know it's only a movie, but somebody wrote that somebody thought it made sense.

It reminds me of Office Space when Bob the consultant says to Peter "So I see you've been missing a lot of work lately..." and Peter replies, "Well, I wouldn't exactly say I've been missing it." Then the Bobs determine that Peter is simply not being challenged enough at his job and has "upper management written all over him" and they give him a promotion.
 
I've been in a couple of situations where a worker (we'll call him Bob for the examples) pulls some strings to get a friend hired, and said friend fires off chestnuts like "I don't have to answer to you I answer to Bob" or "But Bob said I don't have to do anything other than *blank*"

Well the last time this happened (about two weeks ago) we fired both the worker AND Bob. There were a few factors at play but it boils down to the "friend" wasn't working out and Bob was trying to cover for him.

They are trying to push me twords a leadership position here. God. Forbid. :p I don't want to have to deal with situations like this, I just want to make widgets with the machine. :D

Oh God, fire his worthless ass pronto. If you can, that is.

I have several people that I supervise, and there's always one or two who manage to do the least amount of work, with the bare minimum quality, just to avoid getting fired.

I've had people cuss me out, cuss the company out, simply because they didn't like the fact that we were working on topic A instead of topic B. I've had people rant about how stupid company policies are, how they hate the bosses and quality standards we have to maintain, how they know better than anyone else in the company--and then, in the same breath, DEMAND to know why they haven't been promoted. (Gee--can't imagine)

And then there's the guy who is ALWAYS late from lunch, logging in, leaving early---and we're talking about an internet job. He's HOME, on his computer, and STILL can't manage to get to work on time. So, one day, he calls and tells me he's logging out early, because he's dreadfully ill, can't concentrate and needs to lie down. He always has some excuse, so I'm not surprised. I note down the time he leaves and go on about my day.

Then the dumbass apparently butt-dialed me when he sat on his cell phone or something---and I get a call, from his number, where I can hear him laughing, talking, with music playing, etc.

I ratted his ass out to HR right away. Did they fire him? No. He got a warning. That was it. I'm only middle management, so who goes and who stays isn't my decision. But I wish they would fire some of these people because they make extra work for everyone, delay me from helping others because they are so freakin' high maintenance and take hours away from someone else who would be both productive and accurate.

It makes me crazy (ier).

I'm middle management, too- so I'm just trying not to kill him while I'm in the middle of all this. I have enough problems I inherited from this job. I do. Not. Need. This.

Our division director ordered out for fresh homemade cookies one day to thank us for working so hard on the stimulus money that we are distributing from the EPA.

And what does he do? Bitches and turns his lip up because there aren't any chocolate chip cookies.

Please note I've never done that. Heard stories, though.... apparently with the right connections you can get hospital-grade emergency high-velocity/volume jettison laxative and it dissolves into coffee with no taste.

Wow, CD is getting soft in her 'old' age. I mean I thought she was only 29 but clearly she's showing a soft, older sider to herself.
 
Well my boss is in San Francisco so if I called her when running late it would be two hours earlier for her and I'd end up with one very tired boss. ;)

Personally, I'm not sure I could work in a position where there is clock-watching. Then again, if it's a time sensitive position and that was made clear to me from the start and I liked enough other things about the position I guess I could just suck it up.

Oh my god, this sounds all too familiar.

Part of the reason I left my last job was because of one self-proclaimed lazy fathead who was on my team. We began writing him up for *everything* because I wanted him gone--he truly did as little as he could to get by, tried to bend every rule, bitched and moaned about everything, and brought down the rest of us faster than I ever would have thought possible. We couldn't just fire him, as mentioned, because of labour laws, but I would have loved to. And he was so maipulative: It's like he knew the in's and out's of government labour laws and knew exactly when to bring in a note from his doctor or file for disability for some horeshit reason or another. And I "inherited" him too after I took the job. It was most frustrating.

So many things in this thread just make me angry again, and I have been with a different company since November. He was not gone by the time I left.

ETA: And kim, the kicker is that I'm not saying "don't be late, period." I'm just saying "call in and let me know if your're going to be late." I haven't even got on this guy's case about being late. I can just imagine the waterworks if that happened.

Sure, a phone call doesn't hurt but you could also just not have people not fearing for their jobs when they are 30 minutes late, stop collecting hourly timesheets and instead grant them a little bit of occasional flexibility to deal with the fact that they exist in the universe for 16 hours a day they aren't at work.

In return, you get happier, more motivated employees, less paperwork and less crap to deal with in general. It kind of works for Google, Microsoft, Nokia and hundreds of other successful companies.
Fearing for their job? How hard is it to show up on time for work? I mean, shit happens, which is why the phone thing is in place. But if you are showing up late every single day, then why bother? If there are reasons why showing up at a certain time isnt working out, then something can easily be worked out, for example the individual who starts an hour earlier.

People get scheduled to start at a certain time for a reason, not just for shits and giggles. And it's not like they are getting fired immediately, nor were they appropriately warned. Sure, to some people 8 hours does mean a lot, but they were given a fair warning, and if it meant that much to them they would call.

If they want to sit there and abuse the system they must suffer the consequences.

Anyways, thats my rant for the day, and I havent really read past that post :lol:

Do what you can to see if you can 'fix' the issue, which i doubt will happen. Then, my best advice, would be to get his arse out the door faster than you can say 'late'

Not this old shit again - I've had literally 100s of employees over twenty years and there is absolutely no age linkage to this - some older workers are lazy and some young workers are great.

The idea that the older worker is magically better is utter utter shite.

He cries? Tell him to be a man for once in his life. Maybe, just maybe, you can shame him into quitting because you're mean. Seriously, if I were in your shoes, I'd make him cry every chance I got, carefully destroying what little self-esteem he (allegedly) has to the point he'd run out the door never to return.
