O'Brien out, Leno back in?

Leno is the bad guy here. He wants to go back to the 1135 timeslot; he has never been happy about leaving that gig, and he has made it obvious since he left; well he left. Conan got the gig. When Leno's show flopped, and it did, he should have taken the buy out terms and left; but NBC didn't want to pay the 20 million so they dangled the 1135 slot.

The only reason why this is even happening is because LENO agreed to go back to the 1135 slot. Everyone knows this; and that is why Leno is the bad guy. After his 1000 show bombed, he should have taken the 20millioin and 'gone off' into the sunset like carson..or hell..gone to FOX.
Utter and complete bullshit.

Leno was forced out of the 11:35 slot in the first place. That was an NBC decision which, ironically enough, was made to avoid the debacle that occurred when Carson left The Tonight Show. He never wanted to leave The Tonight Show in the first place. But NBC insisted. So he did.

Then he was offered the 10 pm time slot. That wasn't where he wanted to be, but NBC offered him a show, so he took it. Then NBC promised him a -two year- commitment. Leno knew that doing a show like that at 10 pm would be difficult, and have a very rocky start, so he insisted on a long-term commitment to give him a chance to build the show and make it work. Now NBC, not Leno, is trying to back out of that deal and not follow through on the commitment they made to Leno.

Leno cannot just choose to 'take the buyout' and move on. He is under contract to NBC. He only gets the buyout if they breach that contract. Virtually all of the sources we have say that as long as NBC 'reschedules' his show, rather than canceling it, they are not in breach. Leno's only options, then, are to breach the contract himself or go where NBC tells him.

Well... I guess that's that.

I know Conan is supposed to have one more week, but somehow I bet this Friday will be his last. NBC probably wants to put this whole mess behind them as quickly as possible.

Holy crap--I didn't think this situation would get resolved this quickly. It's almost like NBC wanted Jay back in the Tonight Show seat all along, and only presented that Jay/Conan/Fallon plan to piss off Conan and drive him off.

ding ding ding. Winner winner chicken dinner.

That's exactly what this whole thing was. NBC is trying to avoid having to pay Conan what he has under his contract. I'm sure Conan's lawyer and team will argue that by moving the "Tonight Show" 30 mins and introducing another show in front of it then it may have invalidated the Tonight Show which has started after the local news for like what? 45 years? Thus meaning NBC broke Conan's contract and still owes him.

NBC will argue that Conan breached his contract by saying he wouldn't continue to be host at 12:05AM and by his actions and statements demeaning the network.

NBC will argue that they can stick The Tonight Show on at 3pm because the contract doesn't say they can't. NBC will win.

It would be difficult to argue with a 45-year precedence.

Emphasis mine.

Actually, just the opposite. TMZ is reporting LENO'S contract specifically says 10pm, CONAN's doesn't give a time.

So, if NBC were to move Leno, they would in fact breach the contract.

Leno can walk right now...if that's what he wanted to...but, he would rather negotiate a NEW contract and get the Tonight Show back.

A newly signed contract with Leno (for the Tonight Show) probably would have left NBC in a difficult legal situation with Conan, so it's not surprising that such a deal was only a rumor.

I wonder if this means there is now some agreement in place with Conan to let him go.

Of the three in the poll, I'd go with Conan. I'm tired of Leno (overkill, anyone) and Letterman's humor has grown a bit too stale.

However, I much prefer John Stewart to any of the other three.

I don't know why, but that had me

I wonder if this was their plan from the start five years ago. I find it funny that Leno had a specific time in his contract, thus requiring a renegotiation if something changed, but Conan didn't.

It looks to me like this deal was set up in a way that if leno worked out at ten they would keep it, if not, they would pull this at the Olympics break and screw conan.

I'd like to see them just reboot the Tonight Show at this point and go back to its roots, but make it a bit darker and grittier for modern audiences.
