Jack isn't gay though. It's been clearly defined that he's bi-sexual and into everything that moves!! It's become a joke in the series.

I think that in Jack's case "bisexual" includes everything that moves and everything that doesn't. 
Omnisexual is probably the more accurate description for Jack.

The original Star Trek did an episode based on that, too. And of course Children of Earth's plot owes a lot to various political thrillers and alien invasion stories.
Just because a premise has been done before doesn't mean it can't be done in new and interesting ways.
Very true. There are only so many stories under the sun. Then it becomes a matter of variation with some (hopefully) interesting twists and turns.
Interesting premise. I'm interested in Pullman's character and whether or not he can pull it off.
I can imagine the deathrow lawyers trying to get their clients to go through the motions of execution as quickly as possible while their survival rate is still a dead certainty since if the State tries and fails for some reason, they have to let the convict go.
Which is what Bill Pullman's character is all about.
What about incineration?
It's fine to say that people are not dying. But what if there's just "bits" or ash left behind after a furnace has had a good go at disposing with some body.
Some form of regeneration? Instant tissue replacement of broken dead cells, because if cells are just not dying, first that's cancer and we have pounds of flesh and stuff a year/month growing to replace flesh that's flaked off, if our bides are still replacing waste products which are not fobbing off, we'd all start looking like those porridge guardsmen from the three doctors.
In marvel comics the space characters are being attacked by a "cancerverse" where death was murdered and nothing dies. Philosophically it's quite weird to think that death can die.
Was Meet Joe Black a remake of Death takes a Holiday? It took me 15 years to figure out that the Woman in Red was a remake of the 7 year itch. I'm quite slow.

That's an old wives' tale. In fact, execution sentences specifically include the words "until dead" so no enterprising lawyer can make the argument that, hey, you hanged him by the neck, sentence is served, and it's your own fault if he wasn't killed by it. Try making that argument when the sentencing order is that he be "hanged by the neck until dead."
In light of the above, I hope it's not that simple.

Sadly, that's where things like this fall apart. I doubt very much they'll ask the question: What if we incinerate someone? Or just chop their head off?

ive always wondered what would happen if Jack was hit with some sort of death ray, ripping every atom apart? (or just got lost in a transporter pattern buffer)
ok so he could survive when his body was blown to bit, but there was still millions, billions even of his cells intact and joined together, the only surprising thing is that each peice didnt grow into a full version of Captain Jack.
So a bit like the blue guy from Watchmen? Dr Manhattan isn't it?
And it seems interesting, hopefully RtD and co can sustain the success of Children of Earth.
