There's a difference between the right to use footage in another movie and the right to distribute TIH via Disney+. Especially since it is in the distribution specifically that Universal's rights lie.

It is called a mess; the Norton film is undeniably a part of the MCU, yet Disney is trying to write this film out of existence where Norton is concerned, and as you point out, She-Hulk's conflict rests on characters from the Norton Hulk film.

Disney tried to write the 2008 Hulk movie out of existence? Yet, at the same time, allowed William Hurt to appear in three other MCU films? It seems as if Disney Studios, as usual, is constantly inconsistent with all or most of its franchises.
It's like saying "See? Iron Man 2 isn't referenced every seconds in the other MCU movies, it means that Marvel is trying to cancel it!!!"It's an exaggeration. Even the Harlam battle from that movie is referenced. They're consistent enough as any other long running franchise is.
The Incredible Hulk is not being written out. It's just referenced like every other movie in the franchise: not at all until there's a reason to.
