Unfortunately, yes. I recall hearing a couple years ago that Marvel was offering to extend Fox's Daredevil license in exchange for the rights to Silver Surfer and Galactus. Since we're getting a Daredevil show, it would seem that didn't happen.

    Marsden is very sad.
There are also weird "shared properties" like two different Quicksilvers, so maybe Marvel can make a proper Galactus. It's not like there would be confusion between a huge guy with a purple helmet and a black cloud.

Galactus is so strongly associated with Fantastic Four. He's appeared in other properties, but so has Dr. Doom. It's unrealistic to think Marvel Studios can use him.

The Inhumans were pretty strongly associated with FF too. The Inhumans first appeared in FF, and Medusa and Crystal were semi-regulars. Medusa has been a FF team member temporarily replacing Sue, and Crystal has fought alongside the FF and was interested in Johnny before she married Quicksilver. But I guess in the rights deal they got a clean separation.

They have their own comic series (although I guess Silver Surfer did too). Still, Inhumans have a current comic series. There's also the connection between one of the Inhumans and Quicksilver (who is, of course, another Fox property so I'm not sure how far that goes).

Still, it just seems a stretch to think the Silver Surfer isn't just a FF IP.

Inhumans could be a shared IP, theoretically.

Exactly how did some character rights come to be shared ? Were they sold or not ?

Presumably, franchises were sold and then there's the question of whether a character belongs to a particular franchise. For example, Kingpin is one of the most prominent villains in Daredevil, but he originated in Spider-Man, he appeared there quite frequently, he was a major Spider-Man villain in the 90s cartoon, etc. But I can't imagine Daredevil not having him. That's why he's shared.

Suppose that Spider-Man could actually appear in the MCU. How long do y'all suppose that it would take for S.H.I.E.L.D. to track him down and unmask him?

SHIELD is too busy being just half a dozen people to chase after a guy who's doing their job for them.

Don't know about SHIELD but Stark could probably track him down in about two minutes flat

Just have Jarvis collate and track all CCTV & mobile phone footage of him to track his movement patters. That'd lead to clusters of activity and vector termination points around the Bugle, his school and his home neighbourhood. Cross reference people matching Spider-man's approximate height and build with students of that particular high school, that live in that particular area and have a reason to regularly visit the Bugle building in the known time windows.

Then for good measure, run the shortlist candidates through facial recognition for anyone consistently in an area of an incident before and/or after Spider-man shows up, do some fancy holographic arm waving and BOOM! Hello Flash Thompson! ...oh buggerit! ;)

JARVIS wouldn't be misdirected like that. Stark might...but not JARVIS.

SHIELD doesn't exists anymore in the MCU. Besides, Marvel Studios can't even use Spider-man. Not sure why we are even discussing this. :p

I guess this is even more off-topic, but can anyone here justify how Superman in Man of Steel can go around without a mask and not have his secret identity easily discerned by the government's facial recognition?

Because they don't have Jarvis? Seriously, you have any clue what it'd take to FR scan the entire globe? Aside from that the guy was a homeless drifter for what seems his entire adult life. He was off the grid.

...on the other hand Lois didn't need FR to track him down. Maybe afterwards she went back and erases his tracks? At least they didn't do the thing where she can't recognise him with glasses.

Back on topic, when does Guardians of the Galaxy take place in the MCU? It would be neat if part 2 featured our team hearing earth was under attack and they arrive to the portal to earth just in time to see Iron Man carry a nuke through it and exit. I hoped part one would don't something like that (or at least show Red Skull in the background somewhere).

The scenes that connect this movie to the rest of the MCU are the Thanos scene (Avengers) and The Collector (Thor Dark World).

I am not certain, but is the Thanos flunky yelling at (and killed by) Ronan the same one dealing with Loki? If so, we know this film takes place after Avengers.
Edited to Add: Alexis Denisof played the character of The Other in both films. He is the 'flunky' I mentioned above. So this film is set after the events of the Avengers.

Are there any clues in the GotG Collector scenes that would set it as pre- or post- Dark World?

He has a Dark Elf in captivity and has the Aether, so it's after the last Thor film.

Of course Guardians of the Galaxy is set completely after Thor: The Dark World (except for the Star-Lord childhood scenes). The Collector's collection gets blown up in Guardians of the Galaxy!
