Re: Kirk's death should at least be adressed in the next mov
Simply ignore Kirk's death. This can be done with or without Shatner in the movie, and without creating an apocryphal movie (ignore the death as opposed to dwelling on whether it happenned or not).
Last week I was talking to someone who described herself as "a Star Trek fan who lost touch with all the later movies." She was excited by the thougth of a new movie with recasting of the TOS crew. She wasn't aware Kirk had died, and I suspect 99% of the moviewatching market is the same.
