I Am Suspected Of Shoplifting. You're KIDDING?!

If stores don't want you carrying backpacks around, perhaps they should provide a safe place to keep them.

Unless the store somehow asks people to bring backpacks, which most don't, then they are not responsible for those who do. It's not the store's job to be a storage rack for whatever people happen to bring in.

Then either don't expect me to leave my property in a public place or lose my business.

And it's not a matter of stores not asking people to bring them - they are everyday item that people use to carry things around it.

Fair enough. The business that we still have, will more than compensate. ;)

FWIW, in my store we really don't care if people simply bring in backpacks. We have cameras, we can see if people are stuffing merchandise into them without paying. We would not approach any customer unless we had clear evidence of shoplifting.
 
Usually when I carry my bag I have a combo-luggage-lock on it. Not a perfect defense, but better than nothing. I wouldn't be a 100% comfortable leaving at a Customer Service desk, but I'd do it if asked.
 
Legally, he's shoplifting as soon as he moves it with the intention of not paying for it. Yeah, sounds like anytime you move something in a store, it would then qualify, and it could! Silly, huh? Hiding one item inside another qualifies, even before it's left the store.

Nope, they have to walk past the last POS for it to be legally shoplifting. Up until that point they can still pay for it. Doesn't matter where they have put it. They can still claim they were going to pay for it, and the shop would have to prove otherwise. Once they have past the last POS, they can't use I was going to pay defense.

What does last 'point of sale' mean anyway? Is that the last cash register or is that the last spot instore before a person is outside?

As you said it means the last point at which they can pay for the item. And depending on the store layout that is either the last register or the door.

Prior to that it could be classed as attempted shoplifiting.
 
Here what ya' do: Load up your bag with sex toys, lube, cameras, and handcuffs. When they ask to look in your bag, proudly state that all you have in their is your work uniform and show 'em the bag <eg>.
 
Either don't wear the backpack OR change your pattern OR let the manager know you were told and that you would be willing to have your backpack checked at any time.

What absolute rot.

Yeah, I don't see why he would need to volunteer to the search. Sets a dangerous precedent: First time he says no it'd be "A-ha, he's stealing!". Besides if they really thought they had something, they can follow procedure and ask to see it that way. I sure as hell wouldn't give them permission up front.

I have no problem opening my bag when asked (hasn't happened yet) or being ask to leave it as customer service desk. But I'm not going to volunteer to do it if there's no posted notice saying that they require me to do so.
 
UPDATE.

Well, I went back in today - just over two weeks since the incident. Went straight after the gym so had my backpack. Ideally, I wouldn't have carried it but I was in a rush. I made sure not to muck around and promptly got what I wanted. Went to the check out - same girl as before. I gave her a wry smile and placed my items on the counter.

Girl: "You know you can't bring that in here."

*Groan* You're kidding me...

"No I didn't - why?"

And I didn't know. She spoke to me off the record last time - at least that was the impression I was given. She said one of the managers had their suspicions and that she had attempted to dissuade them of said suspicions. No explicit mention was made not bring my bag in. She continued:

"So we know you haven't got anything in your bag. Just put it over there by the window."

She gestured over to the walkway at the end of the checkouts, where everyone walks through. No security. Right.

Again, this was news to me. I don't ever recall seeing a backpack sitting up the front. I asked where the sign was - a natural assumption if this were standard policy. No sign. I made mention that it's never been a problem in the 8 or so years I'd been shopping there. "That's all we're asking," she whispered. Ok, so she was speaking on behalf of the store this time round and seemed a little uncomfortable having to confront me.

Having twice been put in what is a very uncomfortable situation, I went to walk out. I finished with "I assume then no one else is allowed in with a backpack then?" She shrugged her shoulders. :rolleyes:

That is piss poor. If they had a standing policy of no backpacks in the store and I had violated said policy - I would understand. But they don't.

Time to go up the chain-O-command and talk to her boss or even the DM. Just for shits and giggles, I'd drop a e-mail to the company and ask them directly what the company policy is and if backpacks aren't allowed how come no sign is posted.
