I'm sorry for your loss. I've had to put down pets I had for many years, and I know it hurts. It's like losing a member of the family. But as has been said, time will heal those wounds. Try not to wallow in the grief.

I'm curious, because I really want to be stronger, smarter and a better human being by fully understanding your post, do you really advocate the death penalty for people who accidentally run over dogs that are running loose in the street?
 
I'm eating my first real meal now since his death Friday night. I just want to ask, first of all, that we keep this discussion non-agressive. This is a memorial thread. Secondly, I don't believe Juan Bolio was speaking any way other than figuratively and empathetically. He felt the depth of my sorrow and our kindred warrior spirits cried for action. Or something.

Nothing as official, rubber-stamped, and government sanctioned as "the death penalty". She should simply be murdered... if you can even call it "murder". Personally I prefer "justifiable homicide". :borg:

I was asked, and I answered. I won't argue the point. Your thread actually gave me an idea for a memorial thread for all our lost furry friends. I highly doubt this one will get closed because of my opinion on what should happen to the bitch that did this, but if by some chance it happens I'll start just such a memorial thread in Midnight's honor.
 
Juan, I'm not going to close this, but I don't think this is the right place for the advocation of an aggressive response toward someone whose only crime was in not stopping after the accident. As much as you may want it to be, it wasn't her fault.
 
Without steering this thread further off course, you really can't fault the driver for hitting the dog. A small, black dog, darting out into the street, doesn't have much chance. Not sure of the speed of the car, but can't imagine there'd be a lot of time to do anything anyway.

That she didn't stop after is pretty heartless and inexcusablly cruel, but not a crime. I sympathize with Apostle for his loss, but it's hardly a situation to take it out on the driver...
 
The woman was speeding. It was a late Friday night. My grief is compounded by the fact that I honestly believe she was doing twice the legal speed limit.
 
I wouldn't focus on that part. Maybe it puts doubt in your mind, but there's likely very little difference between 25 and 45 or 50 when a tiny object darts out in front of your car. With the dog running out into the street, more a matter of which tire hits it, or whether it gets caught in the underside of the car first. Sounded like he just ran out in front of her, not that he stood in the road while she drove up to him.

For all the sadness involved, it at least sounds (from how I read it) that it was quick and painless, I'd try to take comfort in that. Much more heartbreaking when the animal *kind of* survives, only to suffer a while first, and making it MUCH harder on you...

In your example of the dog as personal property, the woman still wouldn't be criminally liable, but if he could identify her, she could potentially be liable for the "replacement value" of the personal property. Would have to prove that she was negligent, though, which is tough since the dog ran out into the street, and there are probably also leash law technicalities that could help her. Not sure of the dollar amount requiring a stop and a police report in that area.

Again, not saying that this isn't terribly sad, just equating it to a felony is wrong.
 
At least in this country, failing to stop after an RTC is an offence, and a fairly serious one - it will lose you your licence at least. It is irrelevent whether a human is hurt or not, really. A dog counts as property, so there is loss to a party other than the driver - definition of an accident.
 
I hope you got the woman's plate number, etc. & called the police.
I didn't. I was, to be honest, bawling my head off a millisecond after he got hit. I ran to him and picked him up in my arms... felt his heart beating, and rushed to the emergency clinic. He was braindead already... but I thought there would be a chance he could be saved. I mean, he just looks like he could get right back up in the pictures I have.
