CBS/Paramount sues to stop Axanar

Not open for further replies.
I think they're in it for the long haul to make a statement.

This.

The trial costs, unless it gets into the millions, would be a drop in the bucket for CBS and Paramount. Think about how much they pay one cast member of the Big Bang Theory for one episode...

This is to draw a big fucking line in the sand, one that will be understood for years to come.

Don't fuck with CBS/Paramount IP. Or it will fuck with you.

2. Would it be so very wrong if I went full grammar nazi on the difference between infer and imply?

I was hoping someone else would notice! I remained silent for fear of coming off as a pseudointellectual jerk.

Without wanting to come off as a pseudointellectual jerk...(too late?)

Implications are that it can be inferred that Axa-Trek will be impaled on the Sword of Justice, implying that the Judge will deduce (infer) Infringement, indicating that she/he believes the implication on the part of the Infernal Axanarians, that makes inferences in their Axa-actions, those actions indicative of imbibing from the Fountain of Fantasy, as the the ruling will force Axa-Guilt to indie-gogo, using an intergalactic interferometer, desperately seeking new I/O.

Wow!

But there is no real money to be had from Peters even if they are entitled to damages, a trial costs even CBS/P significant money (and even if Peters has to pay their court costs, where does that money come from?), and Peters' reputation is already ruined and he's probably through in the industry.
Can you use GoFundMe for legal expenses?

I was talking with my wife about this mess, and she said, "Imagine if Disney owned Trek." Yeah, the Mouse's lawyers sued a grandmother for hand-making Mickey & Donald patterns on a dress for your five-year-old granddaughter. As bad as things have been and may well become, Axanar has to count their lucky stars it's CBS / Paramount and not Disney the "borrowed" from.

Nope.

According to their terms:

Without limiting the foregoing, you agree to not use the Services to:
A. establish or contribute to any Campaign with the implicit or express purpose relating to any of the following:

12. the defense or support of anyone alleged to be involved in criminal activity;

There's real money to be had from deterring future for-profit tentpole squatters using crowdfunding/nonprofit-fanfilm or any other such end-arounds for cover.

What does the TOS say about non-criminal, civil cases?

Sorry I should have clarified that they disallow them for legal defense for criminal cases but It doesn't say anything specifically about civil cases.

BTW, please let us know what “Ares Studio” will be doing for the rest of the year, certainly want to help support you in whatever else you are doing while the law firm does their jobs. (as I said before I would hate the only winner here to be your Landlord)

OH, COME ON AXANAR FANS! I don't care how financially invested you've become in this and how difficult it is to publicly admit you've backed the wrong horse but how many times must you read "We'll be announcing something cool and exciting really very very soon any day now" before you go, hey, this guy is lying.

Reading some of the comments from Axanar supporters I can see how intoxicating Peters must find it. I mean, some of these guys are practically willing to lay their (online) life down for the cause.

Always teasing something soon................never announcing shit.

The following platforms allow crowdfunding for legal fees:
YMMV

PS hiya Axanar supporters - 'cause we know you're reading this topic - at some point maybe, just maybe, could you put your crowdfunding discretionary income towards things like, oh, I dunno -
  • helping fund the search for a cure for cancer
  • founding a scholarship for students in need
  • supporting your local homeless shelter
  • buying blankets and kibble and cat litter for your local animal shelter
  • cleaning up any local polluted waterway
Far be it from me to tell you how to spend your own money - you are presumably competent adults. All I'm saying is that there are many, many worthy causes out there and while they might not come with nifty patches, they could use your heart, your soul, and your obvious passion.

Thank you for reading.

I have written a new commentary on everything that's happening right now with this case, especially with a lot of the misreporting by several mainstream news outlets on this case:
One problem with your frog story --- it's too similar to the Aesop's Fable "The Shepard and the Lion", which is in the public domain. Someone might be able to challenge the validity of your copyright.

True story from just last week: my wife's best friend has twin daughters who are taking guitar lessons. They just had a recital and played a song they made up. When they were done and their instructor was talking about how good it was (for kids who've been playing for 6-8 months now), and right at the end he said, "Remember, they wrote that, so it's their copyright." :techman:

Well, only if they've fixed it in a tangible medium. ;)
